Providing Gender-Affirming Care to Youth Is Now a Felony After Judge Rules Law Can Go Into Effect
The law had been on hold until the judge could decide whether to block it while a suit against it is heard.

Oklahoma can enforce its law banning and criminalizing gender-affirming care for trans minors while a suit against it is heard, a federal court ruled Thursday.

The U.S. District Court for the Northern District of Oklahoma, in an order made public Friday, declined a request from five families with transgender children and one health care provider to issue a preliminary injunction that would block the law’s enforcement while their suit proceeds. Under an agreement between their lawyers and Oklahoma officials, the law was on hold until the court could rule on the preliminary injunction request.

Judge John F. Heil III said the plaintiffs had not shown that they were likely to succeed in proving that the law violated the due process and equal protection clauses of the Fourteenth Amendment to the U.S. Constitution. He wrote that the law allows gender-affirming care at a later age, and making distinctions based on age is permitted by the Constitution. He also cited a recent appellate court ruling saying states had a legitimate interest in regulating this care and that legislatures, not courts, are the appropriate venue for debates on the matter.

“This an area in which medical and policy debate is unfolding and the Oklahoma Legislature can rationally take the side of caution before permitting irreversible medical treatments of its children,” Heil wrote.
The judge got it wrong (Obviously) it is not a medical and policy debate is unfolding, but rather a settled medical care, for decades trans people have been receiving healthcare, it has been performed since the 1930! Do you remember Lili Elbe the Danish painter who in 1930 had surgery? What it is, is a political campaign by the religious right to use us as scapegoats to win elections.
Lawyers representing the plaintiffs said they will appeal. “This is a devastating result for transgender youth and their families in Oklahoma and across the region,” said a joint statement from Lambda Legal, American Civil Liberties Union, the ACLU of Oklahoma, and the law firm Jenner & Block. “Denying transgender youth equality before the law and needlessly withholding the necessary medical care their families and their doctors know is right for them has caused and will continue to cause serious harm. But this is not the end. We are appealing this decision that is completely out of step with all other federal trial courts and that ignores the overwhelming evidence that gender-affirming medical care is safe and effective evidence-based care. We will continue our fight in defense of our clients and the constitutional rights of transgender people in Oklahoma and across the country.”

Young People Left in Limbo as Battle Over Transgender Care Shifts to Court
When the summer started, transgender-rights supporters were riding a courtroom winning streak.

In state after state — Indiana, Florida, Kentucky and Tennessee — civil rights lawyers persuaded judges to block limits on transition care for minors. They won in front of judges appointed by Barack Obama, and in front of others appointed by Donald J. Trump. They won in state court in Missouri, and in federal courts in Alabama and Arkansas.

But after a run of early rulings favorable to transgender plaintiffs, recent months brought a series of setbacks.

Republican-appointed judges in two federal appellate circuits ruled against plaintiffs and allowed states to start enforcing bans. Efforts to challenge restrictions under state constitutions also faltered, with judges in places like Nebraska and Texas allowing new limits to take effect.

The political and legal chaos is likely to be resolved by the U.S. Supreme Court, which currently has a 6-to-3 conservative majority and has long been an arbiter on questions of the rights of L.G.B.T.Q. people.

In the meantime, transgender minors across the country are left in limbo, unsure if they will be able to fill their next prescription for puberty blockers or hormone therapy.
All around the world the religious right is leading a pogrom campaign to wipe us out, more countries are being added to the list of anti-LGBTQ+ governments.
“There has never been a need for quite the volume of litigation that the L.G.B.T.Q. legal advocacy organizations have had to pull together in short order,” said James Esseks, a lawyer for the American Civil Liberties Union who played a leading role in the fight to legalize same-sex marriage. He added: “This is a degree of crisis we’ve not seen before.”

Then they will come after the gays and lesbians with overturning all the protections we have… their rallying cry will be “States Rights.”
