Selective Justice

The U.S. Department of Justice is going after the state of California over the redistricting but not after the states of Texas, North Carolina,
Republicans are seeking to overturn new congressional district lines that could result in five additional Democratic seats after voters approved the map last week.

The Justice Department on Thursday joined a Republican-led lawsuit that seeks to block a new Democratic-drawn congressional map in California that voters approved last week.

The redrawn district lines could allow Democrats to pick up an additional five House seats in next year’s midterm elections. The Trump administration’s involvement in the case escalates the battle and adds another political layer to the ongoing redistricting efforts that are playing out across the country.

In a complaint filed in federal court Thursday, the Justice Department effectively joined a suit filed last week by the California Republican Party that challenges California’s new map.

In their complaints, the DOJ and the California GOP allege that the new maps approved by voters amount to a “racial gerrymander” that they say violates the U.S. Constitution. The suit claims that California Democrats considered race when proposing the redrawn map in ways that advantage Hispanic voters.
Okay... what about Texas? Or because it is a Republican state they can do what they want?
Voters’ approval of a ballot measure — known as the “Election Rigging Response Act,” or Proposition 50 — earlier this month allows California Democrats to circumvent an independent commission that controls the redistricting process in the state and implement a more partisan map.
Did you get that? Voter approved it! Not the legislature... the voters!

PBS News writes that there is big money behind the redistricting, from the billionaires!
The national implications of California’s ballot measure were clear in both the money it attracted and the high-profile figures who became involved. Tens of millions of dollars flowed into the race, including a $5 million donation to opponents from the Congressional Leadership Fund, the super political action committee tied to House Speaker Mike Johnson, R-La.
Now get this... The Washington Post reported that no other states that redistricted are being sued! They are all Republican states!
Three Republican-led states — Texas, along with Missouri and North Carolina — have not faced federal legal action after revamping district lines following Trump’s call for new maps to expand GOP numbers in the House. Civil rights advocates have argued that the new boundaries in Texas and Missouri illegally disadvantage minority communities at the ballot box.
Everything Trump touches it turn s to trash including the Department of Justice.

Mini-Post: Gerrymandering!

These was a good segment on PBS News Hour about gerrymandering on Monday night.
How GOP-led redistricting efforts may disenfranchise Black voters
By Geoff Bennett & Jonah Anderson

Republicans in North Carolina moved forward with a plan to redraw the state’s congressional map and eliminate its only swing district. It's part of a GOP push to maintain control of Congress through maps that have the effect of diluting Black political power and diminishing the voting strength of communities of color. Geoff Bennett discussed more with Janai Nelson of the NAACP Legal Defense Fund.

Geoff Bennett:
Republican lawmakers in North Carolina moved forward with a proposal today to redraw their state's congressional map in a way that would eliminate its only swing district.

The mid-decade redistricting is part of a nationwide push by President Trump and his Republican allies to help the GOP maintain control of Congress in next year's elections, often through maps that have the effect of diluting Black political power and diminishing the voting strength of communities of color.

Last week, the U.S. Supreme Court appeared willing to issue a ruling that could further that effort during arguments in a Louisiana redistricting case.

NAACP Legal Defense Fund president Janai Nelson argued the case before the court in defense of Louisiana voters, and she joins us now.

Thanks for being with us.

Janai Nelson, President and Director-Counsel, NAACP Legal Defense Fund: Thank you. Happy to be here.

[...]

Geoff Bennett:
And, as we mentioned, North Carolina Republicans are moving forward with this plan to effectively oust one of the state's three Black members of Congress by carving up an area of Eastern North Carolina in this congressional map, and this district happens to have a large Black population.

So how does that square with what constitutes racial dilution under Section 2 of the Voting Rights Act?

Janai Nelson:
Well, it's pretty squarely a violation of the act, as far as I can tell. It is using Black voters as a means for gaining political power or partisan control.

And while the Supreme Court did say in another case, Rucho v. Common Cause, that it will not entertain any partisan gerrymandering claims, racial gerrymandering is still unlawful and it's still justiciable by the court, meaning that those claims are still viable before the court.

And I can't imagine how this map in North Carolina can achieve its partisan goals lawfully in the way that they're trying to do it now without violating the rights of Black voters. And that's why we really need section 2, because Section 2 protects voters from being exploited by politicians or people who simply want to perpetuate discrimination.
Let's face it, the Republicans are sweettalking the judges... no we are not doing this because of diluting the Black vote but we are doing it because of political reasons! It just happens that the Democratic voters are Black.

It all boils down to will the justices believe the song and dance.

Mini-Post: Sorry Charlie

Sorry Charlie, those arrest warrants just don't work out of Texas!

Texas GOP officials on Saturday upped their calls for Democrats who fled the state for California to be arrested, unseated and brought back to the Lone Star State amid a redistricting battle.

Attorney General Ken Paxton (R) and Texas House Speaker Dustin Burrows (R) filed a legal complaint in California urging local law enforcement to act on arrest warrants issued by the Texas statehouse for their colleagues who left the state ahead of a controversial redistricting vote.

[...]

“[California Gov.] Gavin Newsom [(D)] may be comfortable with lawlessness and the protection of corrupt legislators, but Texas will not tolerate elected officials who defy the Constitution for political theater,” he added.
Maybe it is not lawlessness and the protection of corrupt legislators that they are objecting to but rather your attempt to rig the elections that they object to?

Mini-Post: Absolute Power...

Corrupts absolutely!

How long have the Republicans controlled Texas? And now they want to solidify their power with gerrymandering of the Democratic districts... The Attorney General says take it or else!
Attorney General Ken Paxton says he could “lock the doors” on the state’s legislature if it doesn’t approve a radical new congressional map.

Texas Democrats are facing a potential lockdown as they oppose Donald Trump’s legislative redistricting effort.

Texas Attorney General Ken Paxton suggested Thursday that the state legislature could “lock the doors” on liberal-minded party members, trapping them into participating in a forced restructuring of Texas’s congressional maps.

“The House rules and the Senate rules both allow for these people to be arrested if they leave and ... they try to break the quorum,” Paxton told Steve Bannon on his War Room podcast Thursday. “The challenge is if they go out of state, we lose jurisdiction.”
The Republicans are power hungry fascists! Politico reported that the voters don't like the idea either.
A new poll conducted by Texas-based Z to A Research, which does polling for progressive clients, found that 63 percent of likely voters across 22 of Texas’ congressional districts — including 41 percent of Republicans — think the effort to redraw lines in the GOP’s favor is unnecessary.

“As the State Legislature cowers under order from the Trump White House, they need to know that voters are not on their side,” said a memo from the Democratic Congressional Campaign Committee, which commissioned the poll alongside the Democratic House Majority PAC.
The Democrats might have a wedge with...
In the memo, the DCCC accuses Republicans in the state of focusing on the redistricting effort instead of flood relief, which is another topic on the agenda for the legislature’s special session, which began on Monday.

Fifty-three percent of the likely voters polled thought that the legislature was prioritizing redistricting over flood relief, according to the memo, while 32 percent did not, and 54 percent also thought the Texas government is doing a “poor” or “not so good” job of responding to the flood damage.
This is going against the will of the people! The critics say that the Democrats gerrymander, yeah they do but not to this extreme extent.

Absolute Power Corrupts Absolutely!

"A Rose By Any Other Name Would Smell As Sweet"

Have you noticed? That the Republicans don’t want to us the word “abortion” any more, they realize that they f***ed up so now they are trying to rebrand “abortion.”
Now Republicans Are Trying to Redefine Abortion Itself
The New York Times
By Jessica Valenti
October 2, 2023

In the year since Roe v. Wade was overturned, the Republican Party has tested out constantly changing talking points and messages on abortion in an attempt to make its anti-abortion policies sound less extreme. Conservatives are even considering moving away from the term “pro-life,” fearing that voters have newly negative associations with the label.

With post-Roe outrage showing no sign of waning, strategists are pushing a new lexicon on abortion — medically, legally and culturally. Some Republicans have abandoned the term “ban” when speaking about anti-abortion legislation, for example. Now they’re pushing for a 15-week “standard” on abortion — which, to be clear, would be a ban. Americans overwhelmingly oppose strict abortion bans, so Republicans are moving away from the term.

Republicans hope that by changing the way Americans talk about abortion, it might help change the way they feel about abortion — which is, right now, very pro-choice. A record 69 percent of American adults say abortion should generally be legal in the first trimester, and anger over bans has Republicans losing election after election, from ballot measure initiatives in Kansas and Kentucky to the State Supreme Court in Wisconsin.

A skunk is still a skunk by any name! It still stinks to high heaven,
Of course, politicians’ using deceptive talking points isn’t new, but when it comes to an issue like abortion, even just a handful of words can have dire consequences.

Consider the expression “postbirth abortion” — the idea is that abortion involves killing newborns. This is, to be clear, a lie, but that hasn’t stopped candidates like Donald Trump and Ron DeSantis from repeating it.

The phrase “abortion tourism” has also made its way into Republican talking points. This makes it sound as if women traveling to get abortions were taking vacations rather than fleeing their home states for health care, sometimes emptying their bank accounts or staying in shelters in the process.
Ever smell skunk-cabbage in the spring? It stinks!

The Hill writes,
Republicans are struggling over how to craft their message on abortion, an issue that has repeatedly kneecapped GOP candidates and that is seen as a huge problem next November.

No consistent message has emerged from the GOP presidential field, which has been all over the map with its strategies for winning over voters on the issue.
[...]

“The [National Republican Senatorial Committee] is encouraging Republicans to clearly state their opposition to a national abortion ban and support for reasonable limits on late-term abortions when babies can feel pain with exceptions for rape, incest, and life of the mother,” said a source familiar with the strategy being employed by the NRSC. “They are encouraging candidates to contrast that position with Democrats’ support for taxpayer-funded abortion without limits.”

Chamberlain is in agreement that candidates should treat abortion as a state issue. “If you’re a Republican, you support giving more power to the states,” she said.
They are trying to spray air freshener to cover the stink, but not all the Republicans in Congress got the message Sen. Graham introduced one in the Senate and the House Republicans passed "one resolution to condemn attacks on anti-abortion facilities, including crisis pregnancy centers, and a separate bill that would impose new penalties if a doctor refused to care for an infant born alive after an abortion attempt."
Sen. Todd Young, R-Ind., summarized the closed-door meeting on Capitol Hill as being focused on “pro-baby policies.”

Republican strategists are exploring a shift away from “pro-life” messaging on abortion after consistent Election Day losses for the GOP when reproductive rights were on the ballot.

At a closed-door meeting of Senate Republicans this week, the head of a super PAC closely aligned with Senate Minority Leader Mitch McConnell, R-Ky., presented poll results that suggested voters are reacting differently to commonly used terms like “pro-life” and “pro-choice” in the wake of last year’s Supreme Court decision that overturned Roe v. Wade, said several senators who were in the room.

The polling, which NBC News has not independently reviewed, was made available to senators Wednesday by former McConnell aide Steven Law and showed that “pro-life” no longer resonated with voters.

I can’t imagine why the Republicans feel that way, just because every time a referendum on abortion comes up it gets soundly defeated by the voters. You know the voters who the Republicans feel that they don’t vote the “correct way” in other words the party line.

“What intrigued me the most about the results was that ‘pro-choice’ and ‘pro-life’ means something different now, that people see being pro-life as being against all abortions ... at all levels,” Sen. Kevin Cramer, R-N.D., said in an interview Thursday.

Sen. Josh Hawley, R-Mo., said the polling made it clear to him that more specificity is needed in talking about abortion.
Psst, here is a tip for the Republicans, the voters are not dumb. They know it all about a woman’s right to control her own body, they know that you want to take that right away from them. They know.

Time magazine writes…
Within the Republican universe, there are no statistical differences among urban, suburban, and rural voters on abortion. Men and women answer almost identically. While Republicans with a college education are more likely to support abortion rights than those without one, the difference is not significant enough to give those favoring abortion access a plurality let alone a majority. In fact, nowhere in those critical slivers of the electorate registers a winning majority in support of those rights. In other words, at least at this point, the Republican primary universe is not primed to reward those same women who in 2022 told reporters that abortion had soured them on the GOP. Right now, the party’s membership is ready to weigh in on a nominee—and they want someone who promises to fight against restoring abortion rights.

[…]

All of which is to say this: the Republican Party certainly is the party for those who were happy about the end of Roe. But the GOP is by no means monolithic. Trump’s fuzzy position on future abortion restrictions reflects that sentiment. The former President is owning the horse race right now with 54% support, and only DeSantis, the Florida Governor, is hitting double digits with 17%. As the Times’ polling maestro Nate Cohn notes, no candidate who enjoys a 20-point leg up at this point over the last half century has gone on to lose the nomination.
Their evangelical, white nationalist, Christian nationalist crowd is all for abortion bans and that is the Republican dilemma how to keep their base satisfied while pulling the wool over the independent eyes.

In Wisconsin the vote for Supreme Court justice didn't go the way the Republicans wanted... they lost control of the court, the Democrats now have the majority with an important case on gerrymandering coming up.

So the Republicans want to impeach the newly elected justice. With all the push-back the Republicans got cold feet, so they said we will let three retired Supreme Court justices to decide. Well two out of three justices said no to impeachment.

Well the Republicans didn't like that! So...

The Republican leader of Wisconsin’s Assembly refused to back down on Thursday from possibly impeaching a newly elected liberal state Supreme Court justice over her refusal to step aside in a redistricting case, even after two former conservative justices advised him against the unprecedented move.

“No, absolutely not,” Assembly Speaker Robin Vos said when asked at a news conference if impeachment of Justice Janet Protasiewicz was off the table.

“If they decide to inject their own political bias inside the process and not follow the law, we have the ability to go to the U.S. Supreme Court,” Vos said, “and we also have the ability to hold her accountable to the voters of Wisconsin.”
The Republicans complain is that the Democratic judge received campaign funding from groups opposed to the gerrymandering and on the campaign trail she said she was opposed to the gerrymandering.
Protasiewicz last week rejected those arguments, noting that other justices have accepted campaign cash and not recused from cases. She also noted that she never promised or pledged to rule on the redistricting lawsuit in any way. A state judiciary disciplinary panel has rejected several complaints against Protasiewicz that alleged she violated the judicial code of ethics with comments she made during the campaign.

[...]

Other justices, both conservative and liberal, have spoken out in the past on issues that could come before the court, although not always during their run for office like Protasiewicz did. Current justices have also accepted campaign cash from political parties and others with an interest in court cases and haven’t recused themselves. But none of them has faced threats of impeachment.
But that is different! These are Democrats, and the Republicans would never, never, vote the party line. Right, you can't trust these Democrats to do the right thing... vote the way the Republicans party wants.

Stacking The Deck.

Now DeSantis has created a new way to gerrymander… the court districts! Dividing them up so that they will always have a conservative DA and judges! Scary!
This summer, Republicans in Florida launched an under-the-radar, yet incredibly effective, attack on criminal justice reformers in the state. In mid-June, the Republican speaker of Florida’s House of Representatives asked the state Supreme Court to create a commission to look into redrawing judicial circuit borders. By the end of the month, the Florida Supreme Court had created a commission to review its judicial circuits, moving toward a devastating judicial gerrymander. The effort was a seemingly technocratic act, but it’s actually one of the most direct assaults on the politics of criminal justice reform after years of attacks by state-level Republican officials on reforms adopted in their more Democratic cities.
How is able to do this devious thing?
In most states, prosecutors and judges are elected or appointed by county. The borders of counties are fairly fixed. But Florida is one of about 14 states that defines the jurisdictions—and thus the electorate in them—for prosecutors and judges as multi-county circuits. The state’s 67 counties are consolidated into 20 judicial circuits. In theory, the request from Florida House Speaker Paul Renner was made in the name of cost savings and the demographic and population changes since 1969, when the circuit maps were last drawn. But these borders are easy to change in politically motivated ways, and create a lot of opportunities for opportunistic map-drawing.
So they are going to pack the courts! Just like the way that they did with the Supreme Court!

Our little would be dictator DeSantis wants to create a fascist state where he controls every facet in the state. The test is going to come in 2026, DeSantis will have to sit out the election cycle, Ballotpedia says…
The Governor of the State of Florida is an elected constitutional officer, the head of the executive branch, and the highest state office in Florida. The governor is elected by popular election every four years. There is no lifetime limit on the number of times he or she may be elected, but a governor who has been elected to two consecutive terms must be out of office for at least one election cycle before being eligible for re-election.

So it will be interesting to see if DeSantis steps down or changes the Constitution.
