Intersex teacher in Florida says school fired him based on belief he was trans

Shepard Scalf, a Florida teacher who is intersex, is alleging in a new Equal Employment Opportunity Commission filing that his school district fired him because they perceived him as transgender. Scalf was assigned female at birth but identifies as male, per the Monday filing.

In the filing, Scarf claims that, at the same time he was fired, he was told that his performance as a Language Arts teacher at Patriot Oaks Academy in the St. Johns County School District was “exemplary,” and that there was no “merits-based justification” for his termination. Scalf taught sixth grade and had been newly hired for the 2025-2026 school year.

“At the same time, the district knew both that I have a male gender identity (they gave me a placard saying ‘Mr. Scalf’) and that I was assigned female at birth (based on my employment paperwork),” Scarf wrote. “I therefore believe this termination was based on the perception that I am transgender.”

Hey! The Republicans don't care about the little details like he is intersex, all they see is he is not like them. He is different... therefore unacceptable to them.

Per the filing, the letter from Asplen claimed that, due to Scalf being a first-year teacher, his employment was “probationary” and could be dismissed without cause. The letter said he would be placed on temporary leave following a board meeting. Scalf says he was given the choice to accept the probationary release or voluntarily resign. Scalf resigned after being told by the union rep that a resignation would be better for his future career prospects than a termination, according to the EEOC filing.

After his resignation, Scalf says he received evidence that his termination was due to a parent complaining that he was transgender, per the filing.

It will be a hard uphill battle with Florida and Trump's EEOC

It is not us, but them; we were born this way! This is not a choice. We exist in every culture in the world. There are those who worship us; there are those who treat us as equals; and then, there are those who persecute us.

In recent history, we saw Germany go from accepting us to sending us to concentration camps in only a matter of years. Recently, in a span of only seventeen months, we went from being accepted to being threatened with the label of "terrorist."

It is we who are being beaten, threatened, and killed! What exactly have we done?

It is all lies! Everything they say or do against us is a lie. Just look at Kansas: they moved to revoke our driver's licenses. Out of approximately 2 million licensed drivers in the state of Kansas... only 1,800 were trans!

In sports, trans athletes are being called an "assault on women." So, how many trans athletes are there actually? In testimony before a U.S. Senate panel in December 2024, NCAA President Charlie Baker stated that he was aware of fewer than 10 transgender student-athletes among approximately 510,000 NCAA student-athletes nationwide.

It is not in the thousands; it is not even in the hundreds... it is around ten! Ten! One-Zero!

This political push to eradicate us is simply "transphobia" on a national level. We have seen efforts like this in countries such as Kuwait, the United Arab Emirates, Malaysia, and Indonesia, where we can be jailed or worse. In Russia, Belarus, and Hungary, we are treated as criminals. The legal strategy is almost always the same: redefining "sex" as a rigid, narrow biological marker so that anyone who falls outside that box can be erased. Targeting a minority group is rarely just about the group itself; it is about consolidating power by creating a common enemy.

Lesbian, gay, bisexual and transgender people have faced legal proscription for hundreds of years, initially under religious laws, in particular those imposed by the Abrahamic faiths, and later under secular legal codes, often drawing heavily on the theological traditions that preceded them. Legal codes first implemented in Europe proliferated during the colonial period. As the European powers expanded their control and influence over much of the world, they took their legal systems and the laws criminalising LGBT people with them, imposing them over diverse indigenous traditions where same-sex activity and gender diversity did not always carry the same social or religious taboo.

Prohibition Against 'Cross-Dressing'

In 1893, the prohibition against ‘cross-dressing’ for an improper purpose was enacted in Guyana. It took until 2018 for the law to eventually be repealed (see below).

To this day, at least 15 jurisdictions across Africa, Asia and the Middle East still impose criminal sanctions against people whose gender expression does not align with their sex as assigned at birth, using laws that criminalise so called ‘cross-dressing’, disguise, impersonation and/or imitation.

There are two principal historical sources of such laws. In the cases of Guyana, the Gambia and South Sudan, these laws were inherited from British colonial rulers who exported the sumptuary laws that were used to control attire according to occupation, class and gender, resting on a largely Christian ideal of social propriety and morality.

For other states, the criminalisation of gender expression under such ‘cross-dressing’ provisions is rooted in Sharia Law applied in addition to, or in the absence of a statutory criminal provision. For example, section 198(1) of Brunei’s Syariah Penal Code Order 2013, which sanctions “any man who dresses and poses as a woman” and “any woman who dresses and poses as a man”, is broadly used to harass transgender people. Those convicted under this provision are liable to face a fine of up to B$1,000, imprisonment of up to three months, or both.

Basically, the laws against us are a throwback to the 1800s! Mother Nature is being shoved into a box built centuries ago by people who didn't even have a basic understanding of modern genetics or AIS.

Laws That Define Mother Nature

Once again, the courts are trying to decide what a man is and what a woman is. Medical literature generally recognizes between 30 and 40 distinct intersex conditions! Yet, our "fearless" legislators are launching a direct attack on Mother Nature, passing laws claiming there are only two sexes. Consider conditions like 5-Alpha Reductase Deficiency, where an individual can be assigned female but have XY chromosomes.

The UK Supreme Court ruled in April 2025 that the definition of a woman in equalities law is based on biological sex.

The decision, which applies to rules protecting people from discrimination in the workplace and wider society in England, Scotland and Wales, has caused heated debate about the implications for transgender people.

Businesses, public bodies and charities are among those reviewing their policies, particularly around single-sex spaces, such as toilets. A code of practice, produced by the Equality and Human Rights Commission (EHRC), is being considered by the government.

Northern Ireland follows anti-discrimination laws introduced before the 2010 Equality Act.

What is biological sex?

The Supreme Court judgment used a simple definition of biological sex: it is the sex recorded at birth. The court said this is widely used in law.

Critics argue that it is not a complete definition, so it is helpful to know some of the science behind the debate.

Only females can produce eggs and only males can produce sperm. Even if someone cannot have children they are still biologically male or female.

In April 2025, the UK Supreme Court gave its judgment in a long-running argument over how a woman should be defined under equalities law.

The justices ruled unanimously that when the 2010 Equality Act - which applies in England, Scotland and Wales - refers to "a woman" it means a biological female, and that the term "sex" means biological sex. It also said that sex is binary, meaning someone is either male or female.

The For Women Scotland campaign group brought the case against the Scottish government, after it introduced legislation which included some trans women in its definition of women.

However, not every woman assigned female at birth has XX chromosomes or produces eggs! Women with Androgen Insensitivity Syndrome (AIS) do not produce eggs and have XY chromosomes; under the British Court ruling, would all women with AIS now be declared male? And how will they know? Will the courts require everyone in Great Britain to have their chromosomes tested? Or will they only require testing for those women who don't look "feminine" enough? Enforcing such a ruling creates a "privacy nightmare"—short of mandatory genetic testing for the entire population, there is no way for the state to know who carries XY chromosomes with only visual or medical profiling.

The scars have been there as long as Emory Hufbauer can remember. 

When Hufbauer was a baby, doctors performed an operation that Hufbauer describes generally as one that took away their fertility and their ability to produce their own hormones; they also describe it emphatically as intersex genital mutilation.

It was the first of a series of medical interventions they received as a young person in order to organize their body more neatly into a gender binary. Because they couldn’t produce their own hormones after the procedure, they had to take medication. By age 7 or 8, they began expressing that they didn’t like the hormones that were selected for them. But they didn’t learn the word “intersex” until they were a teenager, online. And they didn’t start talking to their parents about it or advocating for themselves and others until they were a legal adult. 

We need to make them fit what our idea of normal is!

There are almost as many people with intersex traits — unique variations in sex characteristics or reproductive anatomy — as there are people with naturally red hair, according to some estimates. (Up to 1.7% of the global population.) There are more than 30 possible variations that can involve a person’s chromosomes, hormones, or organs like testes, ovaries, and more.

There’s little research on the experiences of people who have these variations, but advocates and community groups report that nonconsensual medical interventions are common. In rare cases, they say, there may be a legitimate reason to operate on an infant with intersex traits — for example, if a certain variation carries a known, high risk of cancer developing. In most cases, the difference is benign and intervention is not medically necessary.

We can't have the surgery that we need but they want operate on months old to "correct" them.

Intersex people in Europe face increasing levels of discrimination and harassment, according to a report released Wednesday by the EU Rights Agency (FRA).

The agency said it found the lack of progress alarming as disinformation campaigns online specifically target intersex people. The report includes an online survey of 1,920 intersex people in 30 EU and Western Balkan countries in 2023.

"Intersex people in the EU experience alarming levels of exclusion, discrimination and violence," FRA Director Sirpa Rautio said, calling for "an urgent response."

Europeans who do not fit the typical definition of male or female are grappling with an “alarming” rise in violence, the EU’s leading rights agency has said, as concerted campaigns seek to sow disinformation and fuel hatred towards them.

The findings from the EU’s Agency for Fundamental Rights, published on Tuesday, were based on responses from 1,920 people in 30 countries across Europe. All of them identified as intersex, an umbrella term referring to those with innate variations of sex characteristics and which can also include people who identify as trans, non-binary and gender diverse.

It found that since 2019, the rates of violence and harassment against intersex people have sharply increased – particularly among those who identify as trans, non-binary and gender diverse – far outpacing the increases reported by others in the LGBTQ+ community.

I want to point out that many in the intersex community do not think themselves as part of the LGBTQ+ community.

The Vienna-based agency linked the rise to a wider climate of “increasing or persisting intolerance and bigotry, as well as intense online hatred campaigns” that had “instrumentalised” the LGBT+ community.

“Disinformation campaigns fomenting intolerance and prejudice are often waged by foreign and domestic actors acting to undermine European and western democracies and core values, such as dignity, equality and diversity,” the agency noted.

The result was a “weaponising” of the fact that many people know little about those who identify as intersex, trans, non-binary and gender diverse, allowing these campaigns to spread disinformation and “fuel hatred and violence against them”, it said.

Sound familiar? It should be because "foreign and domestic actors" is the right-wing American organizations!

The report echoes organisations across Europe, who have long warned of politicians using parliament, political rallies and media interviews to fuel anti-LGBTQ+ sentiment and normalise discrimination across the continent.

In 1968, a new name was placed on the United Kingdom’s Official Roll of the Baronetage: Sir Ewan Forbes, the 11th Baronet Forbes of Craigievar. A quintessential Scottish gentleman, Ewan was a perfect fit for his new role. He was a caring country doctor, a doting husband, a sportsman who excelled in riding, shooting, fishing, and Scottish dance, and whose ancient, rather eccentric aristocratic clan had deep ties to the British royal family.

But was he was hiding a secret that we all know all too well!

“His grandfather had been an intimate friend of Queen Victoria; his mother was a close friend of Queen Mary; his father was aide-de-camp to King George V. And their castle, Craigievar Castle (now owned by the National Trust for Scotland), is only 30 miles away from Balmoral,” says Zoë Playdon, emeritus professor of medical humanities at the University of London and author of The Hidden Case of Ewan Forbes: And the Unwritten History of the Trans Experience.

Ewan Forbes was born to a wealthy, landowning family, holders of a baronetcy, in Aberdeenshire, Scotland, in 1912. Assigned female at birth, his true identity was nevertheless clear even in childhood—and so, with the support of his mother, he was taken to European specialists and eventually treated with early preparations of synthetic testosterone. Raised as a boy at home but socially obliged to present himself as a girl in public until his official coming out to the Queen, Ewan grew up, became a doctor, and got married. (This required him to correct the sex on his birth certificate, which was possible at that time without much fuss.) For decades, he lived a quiet life as a husband, doctor, and a pillar of the local community.

But in 1965, Ewan’s older brother died unexpectedly—leaving Ewan, the next oldest man in the family, to inherit the baronetcy. When his cousin John—spurred on by Ewan’s sister—contested the inheritance he was forced to defend his male status in Scotland’s supreme civil court, where he prevailed.

This hugely important case would have changed the lives of trans people across the world—had it not been hidden. The hearing was conducted privately, the media were gagged, and those involved were sworn to secrecy. The case remained unknown until 1996 and is at last described here, along with the life of Ewan Forbes, for the first time. Enlightening and galvanizing, The Hidden Case of Ewan Forbes is a “remarkable…vital historical reference” (Booklist) for transgender history and the ongoing struggle for trans rights.

Wow! But was "he" trans? Or intersexed?

But despite his deep privilege, Ewan’s journey was not an easy one. “Like most trans people, Ewan learned from an early age to be resilient, imaginative, and courageous in facing the challenges that the world threw at him. He’s really very inspirational,” Playdon tells Vanity Fair via email. Ewan’s biggest battle would lead to an invasive court case which led to his ascendence as Baronet Forbes of Craigievar. The case would be shrouded in secrecy for years, and Playdon believes its implications set trans rights back decades.

All arrows point to intersex. KUNO writes,

By the 1920s, synthetic testosterone was being produced and Gwendolyn, Ewan’s mother, took him on a tour of all the medical facilities available. So, by the time he was 17, he was growing both chest and facial hair, and he had avoided the wrong puberty.

Forbes struggled for years, legally and personally, to correct the gender designation of his birth. He began presenting as a young man in the 1930s. Around that time, with his mother’s help, he traveled to Germany to take advantage of early gender reassignment treatments. Then, in 1952, he fought successfully to have his birth certificate changed. He married Isabella Mitchel the same year and settled into the life of a doctor and gentleman farmer.

Starting in 1965, Forbes had to fight again in a struggle to inherit his father’s title. His status as a member of the aristocracy helped him but also resulted in the details of his court case being kept secret. While Forbes’ claim to the title was ultimately upheld, a court recognized his gender as intersex, it did not serve as a precedent other transgender people could benefit from.

I have to wonder if the royalty, inheritance, and the male line of succession had anything to do with it?

Also, the terminology has changed... trans didn't have any meaning back then and neither did intersex? Was he intersex? Was he trans? Or was "he" forced into a male persona because of a mother who wanted to keep the succession in the family?

House GOP advances bill to remove civil rights protections for transgender Iowans

Republicans on the Iowa House Judiciary Committee advanced a bill Monday that would remove civil rights protections for transgender Iowans from state law, as a few hundred people protested the bill at the Statehouse.

The committee vote came just a few hours after Iowans testified at a subcommittee hearing for and against the bill, with protesters chanting, “Trans rights are human rights” and “F*** you, fascists” outside the room. State troopers arrested two protesters.

The bill, introduced last Thursday, would remove gender identity from the Iowa Civil Rights Act, which currently provides transgender Iowans with protection from discrimination in housing, education, employment, public accommodations and credit practices.

It would also bar transgender women from places like women’s public bathrooms, prisons and domestic violence shelters while stating “Separate accommodations are not inherently unequal.” The bill would define “sex” in state law as “the state of being either male or female as observed or clinically verified at birth.”

How infantile and vindictive is that! Of course they don't care that in their persecution they just eliminated all intersex people!

Evelyn Nikkel with conservative group PELLA PAC said the bill would fix that “grievous error” and protect women by keeping transgender women who were assigned male at birth out of women’s bathrooms and prisons. She said having gender identity in the Iowa Civil Rights Act elevates the rights of transgender Iowans over others.

Just more lies coming from another Republican to create fear and animosity against us!

House GOP leaders say those laws are at risk of being struck down by the courts if they don’t remove gender identity from the Iowa Civil Rights Act.

On his first day back in office on Monday, President Trump issued an executive order declaring that the U.S. government would only recognize a person's sex assigned at birth, limit the definition of a "male" or "female" to their reproductive cells and potentially withhold federal funding from programs that acknowledge transgender people or "gender ideology."

Medical and legal experts say the executive order rejects the reality of sexual and gender diversity, and are concerned about the implications it will have for intersex, nonbinary and transgender Americans.

The executive order declares there are only "two sexes, male and female" and defines a "female" as "a person belonging, at conception, to the sex that produces the large reproductive cell." The order defines "male" as "a person belonging, at conception, to the sex that produces the small reproductive cell."

Baker also notes that sexual differentiation via reproductive cells doesn't take place until about six weeks after conception, contrary to the definition stated by the executive order.

It is totally idiotic, lacking the basic understanding of biology. They are locked in the biblical definition of sex and gender totally ignoring and when you talk about biological science to them their eyes glaze over.

Biological sex classification with structural MRI data shows increased misclassification in transgender women

Abstract

Transgender individuals (TIs) show brain-structural alterations that differ from their biological sex as well as their perceived gender. To substantiate evidence that the brain structure of TIs differs from male and female, we use a combined multivariate and univariate approach. Gray matter segments resulting from voxel-based morphometry preprocessing of N = 1753 cisgender (CG) healthy participants were used to train (N = 1402) and validate (20% holdout N = 351) a support-vector machine classifying the biological sex. As a second validation, we classified N = 1104 patients with depression. A third validation was performed using the matched CG sample of the transgender women (TW) application sample. Subsequently, the classifier was applied to N = 26 TW. Finally, we compared brain volumes of CG-men, women, and TW-pre/post treatment cross-sex hormone treatment (CHT) in a univariate analysis controlling for sexual orientation, age, and total brain volume. The application of our biological sex classifier to the transgender sample resulted in a significantly lower true positive rate (TPR-male = 56.0%). The TPR did not differ between CG-individuals with (TPR-male = 86.9%) and without depression (TPR-male = 88.5%). The univariate analysis of the transgender application-sample revealed that TW-pre/post treatment show brain-structural differences from CG-women and CG-men in the putamen and insula, as well as the whole-brain analysis. Our results support the hypothesis that brain structure in TW differs from brain structure of their biological sex (male) as well as their perceived gender (female). This finding substantiates evidence that TIs show specific brain-structural alterations leading to a different pattern of brain structure than CG-individuals.

Conclusions

In this study, we present a highly accurate biological sex classifier in CG-individuals that shows a significantly decreased accuracy in TIs after CHT. Our results underline that the brain structure of TIs is similar to both, the brain structure of their perceived gender and biological sex. This implies that brain structure of TW differs from both CG-men and -women. Based on our brain-structural data, we suggest a dimensional rather than binary gender construct which will contribute to the destigmatization of TIs.

For the right-wing conservatives when you say that the brain structure of transgender women is the same as a cis-women they fall back on XX is a female and XY is a male. That a woman with Alpha-5-reductase deficiency is a XY female, they fall back on their mantra... boy are XY and Girls are XX.

The same thing happen when you mention Androgen insensitivity syndrome females. They reply "god make Adam and Eve! Well Mother Nature had the last word on the subject and she created an infinite variety of combinations. She is constantly trying different combinations!

They don't want to hear that we are born this way because then they can't justify their persecution of us. They are stuck back in the 1950s with a biblical view of sex and gender. 

 

The $64,000 Question

The question is can a presidential executive order override a state law?

That is the question for the next four years... Trump has a slew of EO that he is itching to get out, will they over ride state laws? Since I am not a lawyer I asked Perplexity AI, which is also not a lawyer but it may have more smarts then a lawyer.

So what it seems to say is that Trump cannot override state laws on non-discrimination however they can deny changing gender markers on passports. They can do away with "Non-binary" on federal forms including passports.

President Donald Trump on Monday plans to sign executive orders proclaiming that the U.S. government will recognize only two sexes, male and female, and ending “radical and wasteful” diversity, equity and inclusion programs inside federal agencies, according to senior White House officials.

The officials grouped both orders under the Trump administration’s wider “restoring sanity” agenda. The orders were detailed by an incoming official on a phone call Monday ahead of Trump’s swearing-in.

The official presented the gender order as part of a policy “defending women from gender ideology extremism and restoring biological truth to the federal government.”

The order aims to require that the federal government use the term “sex” instead of “gender,” and directs the State Department and the Department of Homeland Security to “ensure that official government documents, including passports and visas, reflect sex accurately.”

That will deny all intersex people of their true gender! Many intersex people do not identify as the arbitrary gender assigned at birth. The Intersex People Oppose Trump Administration's interACT: Advocates for Intersex Youth writes,

“Intersex people have historically been erased by unnecessary shame, stigma and non-consensual medical intervention. Increasingly we’re speaking out and fighting back, and today louder than ever and in solidarity with our trans and gender non-conforming peers.”

House Speaker Mike Johnson quietly implemented the bathroom ban targeting transgender Rep. Sarah McBride, Democrat of Delaware, following his swearing in to the 119th Congress. 

To the delight of transphobic GOP Rep. Nancy Mace of South Carolina, the policy mandates that single-sex facilities—including restrooms, locker rooms, and changing rooms—be used solely based on a person’s sex assigned at birth. 

“The Chair announces to the House a new policy that will be implemented in the 119th Congress pursuant to clause 3 of rule I,” the Congressional Record states. “In all areas of the Capitol subject to the Speaker’s general control under clause 3 of rule I, all single-sex facilities—such as restrooms, changing rooms, and locker rooms—are reserved for individuals of that biological sex. This policy will be enforced by the Sergeant-at-Arms. It is important to note that each Member office has its own private restroom, and unisex restrooms are available throughout the Capitol.”

But in their nearsightedness they ignore people like her...

U.S. Sen. Roger Marshall (R-Kansas) has introduced a bill that would erase transgender identity from the law.

The “Defining Male and Female Act of 2024” seeks to enshrine gender-specific definitions of various words into law, including the terms “girl,” “boy,” “father,” “mother,” “female,” and “male.”

The bill defines sex as fixed at birth and binary, and defines gender, in certain contexts, as a synonym for sex, while expressly not including gender identity or gender expression.

Under the bill, “male” and “female” are defined as individuals who naturally have — or would have, but for a congenital anomaly — a reproductive system that produces, respectively, sperm or eggs for fertilization.

The bill states that “rare disorders of sexual development are not exceptions to the binary nature of sex,” and that “in no case is an individual’s sex determined by stipulation or self-identification.”

Once again the Republicans are trying to put people in boxes when Mother Nature abhors boxes.
The bill also states that maintaining sex-segregated facilities or sports leagues based on physical differences between the sexes shall not be considered “unequal treatment under the law,” which appears to be an effort to protect against lawsuits brought by transgender advocates.
So tell me are they going to checking every woman’s DNA who enters a bathroom? Or are they just going to pick on women who don’t look feminine?

The Daily Wire writes;

The “Defining Male and Female Act of 2024” would enshrine in law the biological differences between men and women. The proposed legislation, which is backed by a handful of conservative organizations, says the definition is required to combat “increasing confusion about the definition of sex as a biological truth.”

Marshall reiterated that goal to The Daily Wire.

“As a physician who has delivered over 5,000 babies, I can confidently say that politicizing children’s gender to use them as pawns in their radical woke agenda is not only wrong, it is extremely dangerous. I didn’t think we would need legislation to tell us that there are only two sexes: male and female, but here we are,” Marshall said.

So tell me doctor… how many of those babies did you test their DNA? So how do you know that of those 5,000 were AIS babies or  Alpha-5-reductase deficient babies? So tell me how can you lie and say that all of the 5,000 babies are boys and girls?

Marshall’s bill notes that “every individual is either male or female” and that “in no case is an individual’s sex determined by stipulation or self-identification.” It defines a female as “an individual who naturally has, had, will have, or would have, but for a congenital anomaly or intentional or unintentional disruption, the reproductive system that at some point produces, transports, and utilizes eggs for fertilization.”

Doctor I don’t know how to tell you this but you are full of BS! You are just parroting the Republican mantra from the 1950s!

In 1976, a woman from Roanoke, Virginia, named Rhoda received a prescription for two drugs: estrogen and progestin. Twelve months later, a local reporter noted Rhoda’s surprisingly soft skin and visible breasts. He wrote that the drugs had made her “so completely female.”

Indeed, that was the point. The University of Virginia Medical Center in nearby Charlottesville had a clinic specifically for women like Rhoda. In fact, doctors there had been prescribing hormones and performing surgeries – what today we would call gender-affirming care – for years.

The founder of that clinic, Dr. Milton Edgerton, had cut his teeth caring for transgender people at Johns Hopkins University in the 1960s. There, he was part of a team that established the nation’s first university-based Gender Identity Clinic in 1966.

When politicians today refer to gender-affirming care as new, “untested” or “experimental,” they ignore the long history of transgender medicine in the United States.

The Republicans have no qualms about twisting the truth to create negativity against us. They use us as the their straw man to win votes.

They say that our healthcare is experimental but the truth is…

It’s been nearly 60 years since the first transgender medical clinic opened in the U.S., and 47 years since Rhoda started her hormone therapy. Understanding the history of these treatments in the U.S. can be a helpful guide for citizens and legislators in a year when a record number of bills in statehouses target the rights of transgender people.

I also learned that gender-affirming hormone therapies have been prescribed to cisgender youths for generations – despite what contemporary politicians may think. Disability scholar Eli Clare has written of the history and continued practice of prescribing hormones to boys who are too short and girls who are too tall for what is considered a “normal” range for their gender. Because of binary gender norms that celebrate height in men and smallness in women, doctors, parents and ethicists have approved the use of hormonal therapies to make children conform to these gender stereotypes since at least the 1940s.

The Republicans keep harping on puberty blockers saying they are also experimental and does lasting harm to children.

The history of these treatments demonstrates that hormone therapies and puberty blockers have been used on cisgender children in this country – for better or for worse – with the goal of regulating the passage from girlhood to womanhood and from boyhood to manhood. Gender stereotypes concerning the presence or absence of secondary sex characteristics – too tall, too short, too much body hair – have all led parents and doctors to perform gender-affirming care on cisgender children.

But the Republicans conveniently forget to mention when the try to discredit the doctors who treat us!

But we are not the only ones who Gender Confirming Surgery it is also done on day old babies but it seem like the Republicans have no problems with the surgeries.

For over half a century, legal and medical authorities in the U.S. have also approved and administered surgeries and hormone therapies to force the bodies of intersex children to conform to binary gender stereotypes. I myself had genital surgery in infancy to bring my anatomy into alignment with expectations for what a “male” body should look like. In most cases, intersex surgeries are unnecessary for the health or well-being of a child.

The NBC News had this to say about the surgery done on intersex babies.

“Gender normalizing” surgeries have been performed on intersex babies and children since at least the 1950s, often in secrecy, without ever telling the children. In the following decades, some people who underwent these surgeries as children began to speak out against them as human rights violations. Some said they had been assigned the wrong gender, while others had endured severe complications, including sexual dysfunction and infertility.

As their stories piled up, advocacy groups began calling for better education and support for parents of intersex children, as well as for limits on these types of operations. The advocates do not oppose surgery for intersex people in general, but they believe that if the goal is more cosmetic than medical, it’s a choice children should be allowed to make for themselves when they’re older.

Our bodies, our choice!

But in the vast majority of cases, the operations are done to prevent a child from suffering presumed psychological distress later in life, experts said. Surgeons prefer to do these operations when children are between 6 and 18 months old — when healing is believed to be optimal and when children are too young to remember, experts said.

And there has been never a trans person who hasn’t reached the age on consent that had surgery dispirit what the Republican.

Everything the Republicans say are lies and innuendos about us.

Why Montana’s Two-Spirit people are challenging a state law that defines sex as binary

As they fight to reclaim their history, some in Montana’s Two-Spirit community are challenging a state law that defines sex as binary because it “infringes” on their spiritual and cultural beliefs.

The law, Senate Bill 458, defines “male” and “female” based on the presence of XY or XX chromosomes as well as reproductive systems. The legislation, which took effect in October, inserts those definitions of male and female in several parts of the state’s legal code, impacting driver’s licenses, demographic records and the state’s anti-discrimination law.

In October, attorneys representing the Two-Spirit nonprofit Montana Two Spirit Society along with a group of transgender, intersex and nonbinary Montana residents, filed a lawsuit in Missoula County District Court challenging the law.

They argue the state’s definitions of sex “improperly categorizes many Montanans, excludes others from legal recognition entirely, and deprives them of the benefits and protections of myriad state laws.” The complaint also argues the law violates Montana’s individual dignity, equal protection, privacy and freedom of speech laws.

Steven Barrios, a 71-year-old enrolled member of the Blackfeet Nation and co-founder of the Montana Two Spirit Society, said the organization supports efforts to fight back against the state’s new gender definitions.

“We’ve already been traumatized through so many things that the government has done to us and so we just figured it’s time – we have to step up and reclaim what’s rightfully ours and not let the government take that away from us,” Barrios said.

The Republicans are on a mission from god to eradicate us and they don’t care who gets run over in the process.

‘I can be me’: 27th annual Two-Spirit gathering holds greater meaning this year

When Sergio Papa Ruark attended a presentation at his university about Two-Spirit people, he was awestruck.

“I approached the presenter after, and I asked, ‘Are there really more people like us — queer and Native?’” Papa Ruark recalled. “And he said, ‘Yes.’ He told me to search for Two-Spirit gatherings on Google, and that’s what I did.”

Two-Spirit is an umbrella term, referring to Indigenous people who occupy a traditional third gender. Different tribes had different words in their languages for these people, who often held important roles within cultures, seen as medicine people, negotiators, name-givers or critical to certain ceremonies.

For more than 25 years the Montana Two Spirit Society, a Missoula-based organization, has been hosting its annual gathering event, which includes, powwow, ceremony, pageants and presentations on generational trauma, legislation updates and healing. The event celebrates Two-Spirit culture and community and promotes healing.

Trump says that don’t exist in history that we are a new phenomenon… yeah right!

One thing these new laws do not take into account is that the 12 federally recognized tribes in Montana have historically recognized multiple gender identities, including transgender identities. Most Indigenous peoples recognize multiple gender identities that are believed to be the result of supernatural intervention.

In this regard, Montana state Rep. Donavon Hawk, a Democrat from Butte who is Crow and Lakota, said, “It surprises me that this country is only a couple hundred years old, and we are not able to function with LGBTQ people in our communities.” Indigenous communities have incorporated LGBTQ+ peoples within their societies for centuries.

As an Indigenous scholar who studies the history and religion of Indigenous peoples, I am troubled by how these new anti-transgender laws might affect religious expression and the rights of Indigenous communities, not just in Montana but across the nation.

A group of transgender and intersex individuals are suing the state over a new law. Senate Bill 458 revised Montana Code to provide a common definition for the word “sex” when referring to a human.

The lawsuit alleges the bill violates the Montana Constitution and forces gender diverse people to misidentify themselves.

The suit was filed Wednesday in District Court.

Upper Seven Law released the following information:

On Wednesday, a group of transgender and intersex individuals and the Montana Two Spirit Society filed a lawsuit challenging the constitutionality of Senate Bill 458 (“SB 458”), which codifies an unscientific sex and gender binary.

The law effectively eliminates state law protections and benefits for all gender nonconforming Montanans. The bill violates the Montana Constitution’s rights to privacy, dignity, equal protection, and freedom of speech, as well as the First Amendment to the United States Constitution.

SB 458 divides human beings into two exclusive categories—female or male. “Sex,” a term that appears in approximately 40 sections of the Montana Code, is now defined as exactly one of two “without regard to an individual’s psychological, behavioral, social, chosen, or subjective experience of gender.” The law also defines “female” and “male” using imprecise references to reproductive capacity—i.e., sex “chromosomes” and “gametes”—and applies these definitions throughout the Montana Code, affecting everything from discrimination in employment and public accommodations to inmate classification, marriage licenses, cemetery association records, and driver’s licenses.

As a result, SB 458 removes protections in these arenas and others and compels gender diverse people to misidentify themselves on important government forms in a highly personal way. It forces them to disclose private medical and biological information in nearly all aspects of public life. Incredibly, the law ignores intersex conditions as well, compelling intersex Plaintiffs to identify as a sex they were not even assigned at birth. More fundamentally, SB 458 purposefully excludes all trans, nonbinary, intersex, and Two Spirit people from the social and political community, devaluing them and actively refusing to recognize their inherent human worth.

SB 458 serves no legitimate state interest. The bill’s sponsor made clear that it was passed to ensure that legal protections against “sex” discrimination would no longer include “gender” discrimination. He claimed that confusion between the meaning of sex and gender required clarification. Tellingly, the bill makes no attempt to define the term “gender.”

“This is just as much an attack on tribal sovereignty as it is on the LGBTQ+ community,” said David Herrera, the co-founder and executive director of the Montana Two-Spirit Society. “SB 458 continues what colonization has always tried to do—which is to eradicate Two Spirit culture.”

“I am challenging this law because it took me decades to find personal peace—and now the state is trying to take that away from the next generation,” said Susan Edwards, a trans woman who lives in a small community in Eastern Montana. “I stand with the next generation and against discrimination.”

Can you say “Religious Freedom?” Or do they just apply to evangelical Christians? You know the Republicans only care about one religion… the evangelical Christians all the other don’t count.

Ohio Republicans propose nixing home grow, increasing taxes in sweeping changes to legal marijuana

Banning marijuana growing at home, increasing the substance’s tax rate and altering how those taxes get distributed are among vast changes Ohio Senate Republicans proposed Monday to a marijuana legalization measure approved by voters last month.

The changes emerged suddenly in committee just days before the new law is set to take effect, though their fate in the full Senate and the GOP-led House is still unclear.

The ballot measure, dubbed Issue 2, passed on the Nov. 7 election with 57% of the vote and it set to become law this Thursday, making Ohio the 24th state to legalize marijuana for adult recreational use. But as a citizen-initiated statute, the Legislature is free to make tweaks on it, of which they’re attempting plenty.

“The goal of this committee is to provide the people’s wishes with a safe product,” Sen. Michael Rulli, a Columbiana County Republican, said during a meeting of the Senate General Government Committee, where the changes were tacked onto an unrelated alcohol regulation bill.

The Republicans did that with a referendum on abortion did the voters reject banning abortions, South Dakota, Montana, Kansas, and Kentucky they tried to pass anti-abortion laws against the voters wishes.

 Senate changes would prohibit growing marijuana at home, a departure from provisions approved by voters that allow individual Ohioans to grow up to six plants at home and up to 12 per household.

The Senate’s proposal also would increase the approved tax on marijuana products of 10% to 15%. Cultivators would also be taxed at that rate under the revisions.

Local marijuana industry not entirely happy with changes to Issue 2

While the Ohio House debated recreational marijuana on Thursday, the state Senate the night before passed a major overhaul of what the voters decided last month. A few men already involved in Ohio’s marijuana industry had some thoughts on the matter.

Lowellville native Tom Haren is spokesperson for the Coalition to Regulate Marijuana Like Alcohol. He wants no changes made to what voters already approved.

“What the senate passed does not reflect the will of Ohio voters,” Haren said. “Imagine that, that we should respect the will of Ohio voters — I didn’t think that was a crazy concept until yesterday.”

The changes passed in the Senate include:

•     Reducing the number of plants grown from 12 to 6 per household
•     Reducing THC levels for extracts from 90 to 50%
•     Eliminating the social equity program
•     Allowing marijuana to be sold 90 days after passage, instead of after nine months

The changes passed would also eliminate cultivators from automatically getting dispensary licenses and instead open new licenses to an auction or submission process, which cultivator Brian Kessler of Youngstown’s Riviera Creek is opposed to.

Yeah right, “to an auction…” allowing only rich corporations to get a license while the small independents are frozen out.

The Ohio Senate also increased the sales tax on marijuana from 10 to 15 %, which Haren, Kessler and Washington all agree is too much. They say it will only drive people to buy marijuana in “the black market,” or in Michigan.

So much for the will of the voters!

According to statistics cited by the U.N., .05 to 1.7 percent of the world's population is intersex, defined as having external or internal sexual organs that are not clearly male or female. As a matter of course, doctors in the past performed surgery on babies, ostensibly so that they would live a "normal" life. Correspondent Erin Moriarty talks with Pidgeon Pagonis (who was born looking female on the outside but also with testes and XY chromosomes) about Pagonis' memoir, "Nobody Needs to Know"; with professor Elizabeth Reis, author of "Bodies in Doubt: An American History of Intersex"; and with urologist Dr. Ilene Wong, who believes the medical community has failed intersex patients.

What do you call surgery with only a 40 percent success rate?

The very same politicians who are say (Falsely) trans children are too young to have surgery but these politicians are out there praising surgery on month old babies!

These Republican politicians want to define a man and a women as having  XY chromosomes for a male and XX chromosomes which will leave millions of intersex people in limbo. The Republicans think gender is only determined by chromosomes and ignore conditions like Klinefelter’s Syndrome, Turner’s syndrome, Swyer syndrome, 46, XY disorder, or chimera and hormonal AIS, Congenital adrenal hyperplasia, Alpha-5-reductase deficiency.

In their fear of us they rush ahead with these half baked ideas that affects not only us  but all those who are different from them.

So tell me what is wrong with waiting for a child to be old enough for them to make an informed consent. What is wrong with letting a child explore their gender? But these right-wing Republicans want everything to fit nice little orderly boxes. It is the Republican form of OCD everything has to have its place and it drives them bonkers when something is different.

When Sean Saifa Wall was 13, a doctor recommended to his mother that Wall's male-typical genitals be removed and that he begin feminizing hormone therapy.

He says his late mother agreed to the surgery and treatment, but Wall adds that his mother picked the wrong gender for him.

"Receiving my medical records and really learning about what happened to me without my thorough informed consent, I think, made me really angry," Wall, who is now 44, told ABC News.

Wall was born intersex, which encompasses a group of people with genitals, chromosomes, hormones or reproductive organs that are neither clearly male nor female at birth.

Born with partial androgen insensitivity syndrome, or AIS, he had atypical reproductive organs and, like many intersex people, had surgery performed to assign him to one gender over the other without, he says, his consent.

How many times have you heard the Republicans say that children should be allow to transition until they are old enough to decide but at the same time they approve GCS on just days old babies!

Surgeries on intersex children have been condemned by the United Nations, the Human Rights Campaign and intersex activists around the world. However, in the U.S., the federal government has left it up to individual states to create their own laws on gender-affirming care.

Some doctors have defended these surgeries as being an option that should be made available to children and patients. But many intersex patients and advocates say these procedures are medically risky.

Here in Connecticut a bill to ban surgeries on intersex babies was introduced a couple of years back and I testified in favor of the bill but it didn’t make out of committee, the doctors and the Republicans were against the bill!

"The history of surgery to 'fix' intersex children and to normalize their sex organs is a very contentious one," Dr. Ilene Wong, a urologist at MidLantic Urology in Pennsylvania, told ABC News. "And most devastatingly is when kids are assigned or switch to a gender that [parents] think is conforming to their chromosomes, when, in fact, later on they have a vastly different gender identity."

Doctors in the United States continue to perform medically unnecessary surgeries that can inflict permanent harm on intersex children, Human Rights Watch and interACT said in a report released today. Despite decades of controversy over the procedures, doctors operate on children’s gonads, internal sex organs, and genitals when they are too young to participate in the decision, even though the surgeries could be safely deferred.

The 160-page report, “‘I Want to Be Like Nature Made Me’: Medically Unnecessary Surgeries on Intersex Children in the US,” examines the physical and psychological damage caused by medically unnecessary surgery on intersex people, who are born with chromosomes, gonads, sex organs, or genitalia that differ from those seen as socially typical for boys and girls. The report examines the controversy over the operations inside the medical community, and the pressure on parents to opt for surgery.

“The devastation caused by medically unnecessary surgery on intersex infants is both physical and psychological,” said Kimberly Zieselman, an intersex woman and executive director of interACT. “Despite decades of patient advocates putting the medical community on notice about the harm from these procedures, many doctors continue to present these surgeries to parents as good options.”

I have a couple of acquaintances who are intersex and one has been through a half a dozen surgeries that just made it worst and worst.

There is no definitive answer to this question, as there is no comprehensive data on the number of intersex surgeries performed each year, or the percentage of those surgeries that are later found to have been performed on the wrong gender. However, a number of studies have suggested that the percentage of intersex surgeries that are later found to be incorrect is significant.

For example, a 2017 study by the Human Rights Watch found that up to 60% of intersex children who undergo surgery to "normalize" their genitals later identify with a gender that is different from the one they were assigned at birth. Additionally, a 2019 study by the Intersex Society of North America found that 41% of intersex adults who had undergone surgery as children reported feeling that the surgery had been "wrong" for them.

In October, Dutch researchers reported results of what they billed as the largest study to date of continuation of care among transgender youths. In a review of prescription drug records, they found that 704, or 98%, of 720 adolescents who started on puberty blockers before taking hormones had continued with treatment after four years on average. The researchers couldn’t tell from the records why the 16 had discontinued treatment.

The conservative backlash against Bud Light still isn’t over, as self-described “anti-woke” Florida Gov. Ron DeSantis on Thursday explained on Fox News how he’s open to having legal action be taken against its parent company.

DeSantis’ appearance on Jesse Watters Primetime coincided with a letter written by the 2024 presidential candidate, obtained by CNN, that suggests AB InBev “breached legal duties owed to its shareholders” by becoming involved with “radical social ideologies.” Bud Light used transgender social media influencer Dylan Mulvaney to help market its product, after which sales dropped thanks in part to musician Kid Rock and others leading calls for a boycott.

According to DeSantis, the losses that Florida’s pension fund saw after the partnership may be actionable. According to CNN, the pension fund held AB InBev shares valuing $46 million in March this year. Its price has dropped from $66 per share to $58, though the outlet notes it is still higher than its $44 low in Sept 2022. DeSantis, along with the state’s attorney general and chief financial officer–both of which are also Republicans– are trustees of the State Board of Administration, which handles public workers’ retirement funds.

And that is not all, another politician has to put in his two cents.

His latest act comes not long after Sen. Ted Cruz (R-TX) demanded that the Beer Institute investigate Bud Light’s short-lived partnership with Mulvaney—one which the senator claimed also “warrants detailed oversight by Congress.”

I am amazed at how the Republicans are like a feeding frenzy of sharks, they think that they smell blood and go into attack mode. Anything LGBTQ+ is a target for them. 

Now it is businesses they are threaten legal action for normal business decisions. So much for being “Business Friendly.”

Crossed Off My List

Up on the Cape I have been going to a sandwich shop for a number of years, the owner treated me good and we had a good rapport, or so I thought. And he always called me by my first name.

Then this week there were three or four men from a landscaping company there getting their lunches before me and were waiting around for their order. And the owner was bantering with them.

I walk in and the owner says “What can I get you sir?” WTF!

I was too shocked but to do anything but place my order and after I paid he said “Thank you sir.”

The men pick up their order and left.

After they left the owner started small talk with me and called me “Diana” again.

WTF… he is rude to me in front of others and then he acts like nothing happened… Goodbye. You lost a customer who’s been coming to you for years. There are other sandwich shops around and I’ll find another who are not “Fair weather friends.”

That is now the task that the Republicans have given themselves; to define sex & gender!

The Kansas bill had a hearing Wednesday before the state Senate’s health committee and is similar to a Republican measure introduced in the U.S. House last year. Oklahoma’s Legislature is weighing a similar proposal, while North Dakota lawmakers are considering a resolution that would urge public schools and other “public entities” to distinguish “between the sexes according to biological sex at birth.” Mississippi lawmakers had three proposals like Kansas’, but none advanced this year.

New Hampshire, Tennessee and Texas also have proposals to define male and female in state law, and a Republican lawmaker in South Carolina has proposed an amendment to the state’s constitution to declare that legally, a person’s gender would be based on anatomy at birth, not a “psychological, chosen, or subjective experience of gender.”

That is an impossible task, Mother Nature does not like to be put in boxes!

Brandi also said proclaiming that sex is binary ignores that intersex conditions and differences in gender identity exist.

At birth, external genital anatomy can be ambiguous, sometimes because of differences in sex development, or intersex conditions, which affect about 1% of the population.

Intersex conditions can involve external genitals that don’t match a person’s sex chromosomes. In one condition, testes develop internally but external genitals and breasts appear female. These babies are usually assigned female at birth, but their bodies will never produce eggs.

“There’s variation,” Brandi said. “Not everyone fits into this exact box.’’

There has been much research into how people identify their gender and guess what? They determined that gender is in our heads. The researchers looked at intersex people who were operated on to “correct” gender. In a New York Times article…

Declaring With Clarity, When Gender Is Ambiguous

Dr. William G. Reiner, a faculty member at the University of Oklahoma and Johns Hopkins, says he is just a "dull guy leading a dull life."

That seems unlikely. A 57-year-old psychiatrist and urologist, Dr. Reiner is a leading specialist in the treatment of children with the intersexual condition, boys and girls born with ambiguous genitalia.

"I like working with these children," he said on a break in a meeting in Washington, where he had made a presentation before the American Association for the Advancement of Science. "They've had atypical life experiences, and they tend to be extraordinarily sensitive and vulnerable. They see an aspect of what it means to be alive in a different way from the rest of us."

Q. Aren't these intersex conditions rather rare?

A. There are probably around 1,000 intersex babies born every year in the United States. The numbers can add up. The term actually refers to six different conditions where children are born with ambiguous sexual structures.

You can get genetic girls who look from the outside like males because they were exposed to male hormones at a critical stage of fetal development. Conversely, you can get genetic males looking like females because they didn't get enough male hormones in utero.

So what did he find?

Q. How do you know what constitutes gender identity?

A. As part of a research study, I've personally seen and assessed 400 children with major anomalies of the genitals. Of those, approximately 100 might be called "intersex." Our findings have been many and complex. The most important is that about 60 percent of the genetic male children raised as female have retransitioned into males.

Did you get that? There is something inside us that tells us that we are male or female… not what’s between your legs!

Q. What conclusions do you draw from your study?

A. That sexual identity is individual, unique and intuitive and that the only person who really knows what it is is the person themselves. If we as physicians or scientists want to know about a person's sexual identity, we have to ask them.

And here these Republicans in their animosity against us have given themselves a Sisyphean Task, to define the impossible, I can see many, many lawsuits going to the Supreme Court for the courts to rule on something that can’t be defined.

Can you imagine what garbage is going to come out of this animosity will be? Can you imagine what it will be like if you are a cis gender woman and you have to prove your gender because you look too masculine... how degrading! 

I am a woman because I know myself to be a woman.

Nature Is Amazing!

We are so diversity, there is no one average person we are all unique in someway or other and when you try to put people in boxes it fails horribly.

Uproar continues to cloud the start of the Tokyo Olympics as more Black athletes find themselves disqualified from races. The latest are two Namibian runners, Christine Mboma and Beatrice Masilingi, who were barred from the 400 meters race due to test results indicating each having naturally high levels of testosterone.

Mboma set a new record for females under the age of 20 when she ran the race in 48.54 seconds on June 30. Her time was the seventh-fastest in women’s 400 meters history and the fastest in the world this year. Masilingi ran the race in 49.53 during a meet in Zambia three months ago. Her time is the third-fastest of the year. The impressive race times prompted the World Athletics body to run medical assessments.

“The results from the testing center indicated that both athletes have a naturally high testosterone level. According to the rule of World Athletics, this means that they are not eligible to participate in events from 400m to 1600m,” said the national Olympic committee in a statement released July 2. Both women also declined to take birth control drugs to lower their testosterone levels.

This is so much more than being racist… this is anti-human!

We are so diverse, it is impossible to say who is male and who is female and it is not only testosterone that gives an athlete and advantage. What about tall women, they have the advantage in track and basketball. Some people are naturally overweight, some people are naturally thin.

“This means we need to be clear about the competition criteria for these two categories. Our evidence and data show that testosterone, either naturally produced or artificially inserted into the body, provides significant performance advantages in female athletes. The revised rules are not about cheating, no athlete with a DSD [Difference of Sexual Development] has cheated, they are about levelling the playing field to ensure fair and meaningful competition in the sport of athletics where success is determined by talent, dedication and hard work rather than other contributing factors.”

So if you are born intersex does this mean that you cannot take part in sports? What about women with PCOS, they produce too much testosterone in their ovaries will they be banned?

What about women who look masculine will they forever be challenged to prove that they are a woman for sports?

Putting people in boxes does not work.
