DEI

Or is it DIE? “Die” feels more fitting with the way the Trump administration is attacking our community. When I used to do diversity training I used to use the case of Lynn Conway. I first found out about her back around 2005, when things were slow at work, I started looking up the old computers I’d worked on, IBM 1620, IBM 360, PDP-8, and so on. I came across an article about the IBM 360 and something called dynamic instruction scheduling. Huh. It described how one engineer helped develop the idea, but then work got in the way of my curiosity.

A couple of months later, I remembered the article and went back to it. This time I noticed it was about a woman. That caught my attention.

Being trans, my radar went off—beep, beep.

I found her university webpage; she was a Professor Emeritus. I learned that when she transitioned, she was asked to leave IBM... she didn’t fit the “flat-top haircut, thin blue tie, blue sports jacket with a white shirt and a pocket protector” mold.

IBM’s loss was significant. She went on to become a leader in integrated circuit design, worked with DARPA, and later received the IEEE Computer Society’s Computer Pioneer Award for her foundational contributions to computer architecture and VLSI design.

When I taught diversity, I used her story as an example: IBM let go of a highly talented engineer because she was trans—it was our gain and IBM loss.

Not With Trump!

Maybe we need this now more than ever!

Celebrating Diversity: Embracing a World of Differences
As we celebrate Diversity Month, it’s important to remember that diversity is not just a buzzword. Diversity Month is a celebration of differences that help us to learn, grow and understand each other better. By embracing diversity, we can create an inclusive environment where everyone feels welcomed and valued.

Why It’s Important To Celebrate Diversity Celebrate Diversity
Diversity promotes inclusivity, understanding, and appreciation for different cultures, backgrounds, and perspectives. When we celebrate diversity, we recognize the value of each individual and acknowledge the contributions that people from different backgrounds can bring to our society.

Just a few of the reasons why it is important to celebrate diversity:
  • Encourage inclusivity: Celebrating diversity encourages inclusivity and helps to create a more welcoming environment for people from all backgrounds.
  • Promote understanding: Celebrating diversity can help to promote understanding and tolerance. By learning about different cultures and experiences, we can gain a better understanding of the challenges and struggles faced by people from different backgrounds.
  • Help to combat discrimination and racism: Celebrating diversity helps to combat discrimination and racism by creating awareness about the importance of accepting and valuing people from different backgrounds.
  • Challenge stereotypes: When we celebrate our differences, and are open to our diversity, we can challenge common stereotypes by promoting a more nuanced and complex understanding of different cultures and backgrounds. We can highlight the diversity within different communities and showcase the unique strengths and talents of individuals from different backgrounds.
  • Foster creativity and innovation: By bringing together people from different backgrounds and experiences, diversity can foster creativity and innovation. It can also lead to new ideas, perspectives, and solutions to problems.
  • Enhance personal growth: Celebrating diversity can enhance personal growth by exposing us to new ideas, perspectives, and experiences. It can also help us to develop greater empathy and compassion for others.
When I think of diversity I think of Lynn Conway and IBM firing her when she transitioned! Among her many accolades she was name a IEEE Fellow (Institute of Electrical and Electronic Engineers) as a pioneer in integrated circuits.

With Trump stamping out anything DEI he is harming one of our greatest national treasures, our diversity! No other nation has the diversity that we have!

Lies, Lies, And More Lies

You all heard about the crash into the Potomac, will the MAGA is spreading lies about it...
A decorated trans army service member, Jo Ellis, has taken to Facebook to debunk viral claims that she was the pilot of the Black Hawk helicopter that was involved in the fatal mid-air crash in Washington on Wednesday.
Pink News

January 31, 2025

67 people are believed to have been killed in the incident, after an American Airlines plane from Kansas carrying 64 people onboard collided with a military helicopter, manned by three personnel, the BBC reports.

Following the tragedy, an X account called FakeGayPolitics shared a post that claimed Jo Ellis was the pilot of the helicopter at the time of the crash. It has since gone viral, and has even been picked up by various news sources, despite being false.

The misinformation states “The pilot of the Black Hawk has been identified as Chief Warrant Officer 2 (CW2) Jo Ellis, a transgender woman. Jo Ellis served in the Virginia National Guard for 15 years and transitioned while serving as a pilot. Jo has been making radicalized anti-Trump statements on socials.”
It is totally illogical... she is alive how could she have been piloting the helicopter? All on board died!
In response, Jo Ellis took to her personal Facebook page on Friday (31 January) to debunk the claims, sharing a screenshot of the viral tweet and writing: “Some craziness has happened on the internet and I’m being named as one of the pilots of the DC crash. Please report any accounts or posts you see. It’s insulting to the victims and families of those lost and they deserve better than this BS from the bots and trolls of the internet.”
The are being egged on by Trump...

In a Thursday press briefing, President Trump criticized his predecessor for his management of the Federal Aviation Administration and suggested, without evidence, that diversity initiatives at the agency could be to blame for a deadly crash between a passenger plane and an Army helicopter in Washington, D.C.

"I put safety first. Obama, Biden and the Democrats put policy first," Mr. Trump said. "The FAA's website states they include hearing, vision, missing extremities, partial paralysis, complete paralysis, epilepsy, severe intellectual disability, psychiatric disability, and dwarfism." Mr. Trump added that people in those categories would be "qualified" for controller positions, even though the agency's statement does not say that.

The president continued, "Brilliant people have to be in those positions."
He even contradicted himself, ABC News reported that...
"I put safety first, Obama, Biden and the Democrats put policy first, and they put politics at a level that nobody's ever seen," Trump told reporters in the White House briefing room, referring to the policies, even as the investigation into what happened is just getting underway.
But the press secretary contradicted him,
When asked in the earlier briefing by ABC News Chief White House Correspondent Mary Bruce whether he was saying the crash was the result of diversity hiring, Trump said, "we don't know" what caused the crash, adding investigators are still looking into that. "It just could have been. We have a high standard. We've had a higher, much higher standard than anybody else."
Trump said that,
Trump said Pete Buttigieg, the transportation secretary in the Biden administration, "just got a good line of bulls---" and said he had "run [the Department of Transportation] right into the ground with his diversity."
Pink News ended with,
Asked by a reporter how he could blame the initiatives for the crash when an investigation into the incident had only just begun, Trump said: “Because I have common sense.”
How can you trust someone that is a habitual liar? It is one lie after another! Here in the middle of this disaster and Trump and his cronies tries to blame the Democrats... he play politics with their lives!

Then you have the falsely accused trans helicopter pilot, the New York Time wrote...
Jo Ellis, a helicopter pilot in the Virginia Army National Guard, was falsely identified as the captain of the crashed Black Hawk helicopter in thousands of social media posts this week. The flurry of falsehoods were so extreme that Ms. Ellis, who is transgender, posted a “proof of life” video to Facebook clarifying that she is alive and had not flown the crashed chopper.

The falsehoods, which tried to tie Ms. Ellis’s transgender identity to the tragedy, spread online shortly after President Trump and his allies attempted to tie the crash in Washington, D.C., to so-called “D.E.I. programs,” an array of initiatives meant to boost diversity, equity and inclusion in the workplace. There is no evidence that such programs played any role in the crash.

“I understand some people have associated me with the crash in D.C. and that is false,” Ms. Ellis said in a video posted to her Facebook account. “It is insulting to the families to try to tie this to some sort of political agenda. They don’t deserve that. I don’t deserve this.”
Anything to cast aspersions on our community!

President Donald Trump has revoked the Equal Employment Opportunity Act of 1965, the latest update to his raft of executive orders since he was sworn into office.

On his first day in office, Trump signed an anti-trans executive order proclaiming there are “only two sexes” – which was later debunked by United States Representative Sarah McBride – and ordered the overturning of the birthright citizenship.

Trump went one step further and revoked policies which boosted diversity, equality and inclusion for historically marginalised communities, including Latine people, Native Americans and Black Americans.

The White House said in a statement: “The injection of ‘diversity, equity, and inclusion’ (DEI) into our institutions has corrupted them by replacing hard work, merit, and equality with a divisive and dangerous preferential hierarchy.”

On Tuesday (21 January), Trump revoked Executive Order 11246, the Equal Employment Opportunity Act. President Johnson signed the original order on 24 September 1965, two years after Rev. Martin Luther King Jr. delivered his “I Have A Dream” speech at the Lincoln Memorial.
I don't know about you but I signed many diversity statements in my 40 years working and not one of them said anything about hiring minorities... all they said was I will not discriminate in hiring. And that is what gets the Republicans all in a tizzy. They want to discriminate! They want to fire us when we transition. They want to refuse to hire Blacks, Jews, or Muslims,
Trump’s order stated: “These illegal DEI and DEIA policies also threaten the safety of American men, women, and children across the Nation by diminishing the importance of individual merit, aptitude, hard work, and determination when selecting people for jobs and services in key sectors of American society, including all levels of government, and the medical, aviation, and law-enforcement communities.”
Notice the language he uses... "illegal DEI and DEIA" they are not illegal! But what do you expect from Trump... he lies constantly. The Harvard Business Review writes,,,

There’s a hustle afoot around the Supreme Court’s recent decision striking down affirmative action, Students for Fair Admissions v. Harvard. In a blog post titled “America First Legal Puts Woke Corporations… on Notice,” America First Legal, an organization headed by former Trump advisor Stephen Miller, asserts that “all DEI programs” are now “illegal.” Miller offers pro bono legal help against “institutions perpetuating woke fascist bigotry against our fellow citizens.”

This is politics, folks; don’t mistake it for law.

At the most basic level, the Supreme Court’s decision interpreted the Equal Protection Clause of the U.S. Constitution, which does not typically apply to private employers. Also basic: Race-based employment decisions already were illegal under Title VII, a federal statute. That precludes practices like reserving hiring or promotion slots for people of color and using race as a tiebreaker.

Moreover, nine states already prohibit affirmative action based on race, typically based on their state constitutions. In California, where I live, Proposition 209 prohibited affirmative action based on race in state university admissions, state hiring, and state contracting nearly 30 years ago. I have never heard a whisper that Prop 209 makes DEI programs of private companies illegal.

So commentary opining that “corporations…[will] just shut down all their DEI work” and “corporate diversity efforts [are] in legal trouble” seems a bit hysterical.
No they are not hysterical, they are targeted to promote the party line... DEI is bad!

When you are a racist... DEI programs are bad!

By the way,,, all this DEI stuff comes out of Project 2025:
Legal Defense and Educational Fund, Thurgood Marshall Institute

Project 2025 will dismantle the civil rights tools that people living in the United States have relied on for decades to create a fairer and more inclusive society and economy, and eliminate federal policies and practices that help ensure equal opportunities for Black people. These proposals, from ending data collection on race to weakening the government’s ability to fight discrimination, will frustrate efforts to remedy racial inequality. Opponents of civil rights are already working to turn these proposals into reality.

In terms of civil rights enforcement, Project 2025 will harm Black communities by:
  • Preventing the enforcement of anti-discrimination laws by halting the collection of workforce data
  • Eliminating policies that ensure equal employment opportunities at the federal level
  • Curtailing civil rights protections, making it harder to identify and remedy discrimination
  • Weaponizing civil rights enforcement by the EEOC and the DOJ
  • Importance of Anti-Discrimination Tools
LDF's Vision for Civil Rights and Equal Opportunity
The foundation of a thriving multi-racial democracy is a society in which high-quality education, good jobs, and economic mobility are available to all—regardless of race, gender, sexual orientation, disability, or other protected characteristics. All Americans benefit from workplaces and institutions where everyone is valued and can contribute their skills and perspectives. Talent is everywhere; policymakers must ensure that opportunity is, too.

Importantly, removing barriers for Black people and other historically marginalized groups increases opportunities for all. Closing racial gaps in wages and access to financial and educational resources will help grow the economy. Due to discrimination, since 2000 the United States has lost out on $16 trillion in goods and services.44 As the nation becomes increasingly diverse, creating an inclusive and equitable society is an even greater moral and economic imperative.
Do you remember the salute that Musk made during the inauguration ceremonies? I think that it  might be starting to make sense?

A Little Good News

You have seen how businesses have been backing off their diversity program well one company stood up and buzz off!
CNN
By Nathaniel Meyersohn
December 27, 2024

Costco is battling an anti-DEI wave with a stern rebuke to activist shareholders looking to end the warehouse retailer’s diversity ambitions.

Walmart, John Deere, Tractor Supply and other companies are changing or walking away from diversity, equity and inclusion (DEI) policies. But Costco believes DEI helps its “treasure hunt” shopping atmosphere, and it is standing behind its efforts.

Costco’s board of directors unanimously recommended that its shareholders vote against a proposal brought by a conservative think tank, the National Center for Public Policy Research, that would require Costco to evaluate and issue a report on the financial risks of maintaining its diversity and inclusion goals. The group criticized Costco for possible “illegal discrimination” against employees who are “white, Asian, male or straight.”
You know the dribble that the conservatives push about how the Whites are discriminated against. If a minority is hired instead a White person by their definition it must be discrimination.
Costco has a chief diversity officer and a supplier program that focuses on expanding with small and diverse businesses. It also donates to organizations like the Thurgood Marshall College Fund that serve minorities and underrepresented groups.
OMG! OMG! They are must be discriminating against us because they donate to a Black college fund! Um… what about all their other donations to non-Black colleges?
“Among other things, a diverse group of employees helps bring originality and creativity to our merchandise offerings, promoting the ‘treasure hunt’ that our customers value,” Costco said in its proxy statement to investors. “We believe (and member feedback shows) that many of our members like to see themselves reflected in the people in our warehouses with whom they interact.”
They make that sound like a bad idea, having diverse workforce.

When I hear of things like this I am reminded of IBM back in the late 60s and early 70s, they had this bright engineer that co-foundered one of the major advancement in computer science and they booted her out when she came out trans. Lynn Conway went on to be come one of the major innovators in computing. (You can read her story here, and it is very, very interesting.) By the way the same thing may have happened when these two hippies Jobs and Wozniak walked in trying to sell them on the idea of a desktop computer to the mainframe computer company.
There’s no single definition of DEI, but it’s generally a mix of employee training, employee resource networks and recruiting practices to advance representation of people of different races, genders and classes, people with disabilities, veterans and others.

The shareholder resolution contends that Costco’s DEI practices are potentially discriminatory. But Costco said its policies are legal and non-discriminatory.
Diversity is good!

Woke Is Dead!

Woke is dead in Florida!

Woke has been put to sleep permanently!
AP News
July 26, 2024

 A judge issued a final order Friday to overturn a Florida law pushed by Republican Gov. Ron DeSantis that attempted to limit diversity and race-based discussions in private workplaces.

U.S. District Judge Mark Walker previously ruled the law is unconstitutional. That decision was upheld by an appeals court in March. Walker’s latest order makes his temporary injunction permanent.

The law, called the ‘“Stop WOKE Act,” attempted to prohibit teaching or business practices that contend members of one ethnic group are inherently racist and should feel guilt for past actions committed by others. It also bars the notion that a person’s status as privileged or oppressed is necessarily determined by their race or gender, or that discrimination is acceptable to achieve diversity.
The National Review writes...
“Today’s decision serves as a powerful reminder that the First Amendment cannot be warped to serve the interests of elected officials,” special counsel Shalini Goel Agarwal of Protect Democracy, which represented businesses that sued Florida, said following the latest decision.
Law & Crime reports,
Judge Mark Walker of the U.S. District Court for the Northern District of Florida issued a permanent injunction, saying the law that bans diversity training in private workplaces “violates free speech rights under the First and Fourteenth Amendments to the U.S. Constitution.” The ruling follows a three-judge appeals court panel’s March decision that upheld Walker’s original injunction. The State of Florida did not oppose the motion to make the ruling permanent.
Ding dong, the wicked old bill is dead!

I Signed One. Did You?

When you start out in a job you are giving a mound of paperwork to read and usually one them is a non-discrimination policies.
The recent Supreme Court decision on affirmative action in college admissions emboldened objectors to corporate DEI practices. Here’s what might change.
Washington Post
By Taylor Telford
October 2, 2023

When the U.S. Supreme Court struck down affirmative action in college admissions in June, the effects ricocheted far beyond academia. In recent months, a flurry of litigation has aimed to translate the court’s race-blind stance on education to corporate diversity and inclusion policies.

Companies have long tried to eliminate inequality in their ranks, in part by encouraging the hiring and promotion of women and racial minorities. But recent lawsuits claim those efforts perpetuate discrimination on the basis of race and gender — the very injustice they claim to stamp out.
I don’t know about you but those statements that you had to sign didn’t say we are hiring more Balck or minorities, they just said that we will hire the best person for the job.
Conservative politicians and advocacy groups also have been challenging DEI practices. For example, Florida Gov. Ron DeSantis (R) has barred spending on DEI at public colleges and universities in his state, declaring “Florida is where ‘woke’ goes to die.”

In July, 13 Republican attorneys general sent a letter urging Microsoft and other Fortune 100 companies to reexamine their DEI policies in response to the Supreme Court ruling on affirmative action. The letter threatened “serious legal consequences” for companies that rely on race-based employment preferences, including “explicit racial quotas and preferences in hiring, recruiting, retention, promotion and advancement.”
These Republicans confuse discriminating with teaching diversity.
In recent months, a steady trickle of lawsuits and decisions has challenged the legality of DEI policies and practices in the workplace. A few have been filed by the American Alliance for Equal Rights (AAER), a group founded by conservative activist Edward Blum, who was behind the cases that culminated in the Supreme Court striking down affirmative action in college admissions.
There is a large network of conservative legal organizations that brings these lawsuits against us.

Homogeneous v. Diverse (Or the case for DEI)

[Editorial]

The “War” on “Woke”

I used to do diversity training and every once in a while I got asked why is diversity important?

I don’t know if you remember the IBM of the 60s,and 70s you could tell an IBM salesman a mile off and I do mean “man.” Not women. That was unheard of back then, it was a man’s club or more precisely a “white” man’s club.

They had a uniform… a “Flattop” haircut and I don’t mean the current “Flattop” haircuts I mean the “Flattops” of the fifites. You know the type I’m talking about, you see them in the movie Apollo 13 in the scene of NASA Flight Control room.

The other parts of the IBM uniform was a blue sports jacket, a thin blue tie, and a white shirt with a pocket protector. Yup you could spot them a mile off.

In walks two hippies, we got this get idea… a little desktop computer. Now these to long hair types wanted to sell their little desktop computer to a mainframe company! The two long hair hippie type freaks got the bum rush out of IBM and they went on to form Apple Computer.

Then there was the case of a trans woman at IBM… No Way! She was shown the door so fast! She worked on a team developing a super computer back in the 70s. While there she developed along with another colleague away to speed up computers that went on to be the basis for all computers today. She went on to be awarded the Computer Pioneer Award of the IEEE Computer Society,
Lynn Conway was born in Mount Vernon, N.Y., in 1938. After studying physics at M.I.T., and earning a B.S. (1962) and M.S.E.E. (1963) at Columbia University, Lynn joined IBM Research in Yorktown Heights, N.Y. Working on IBM's Advanced Computing Systems project, she made foundational contributions to computer architecture including invention of multiple-out-of-order dynamic instruction scheduling.
Sadly, IBM fired Lynn as she underwent gender transition in 1968. Starting all over again in a covert new identity, Lynn advanced rapidly to become a computer architect at Memorex, but also began decades living in fear of being 'outed' and again losing her career.
Because of the culture in IBM… “Mainframes are the Kings” they didn’t look outside the big blue box and they missed the PC revolution and because of the anti-LGBTQ climate at the time they didn’t recognized the talent that they had and let her go because she didn’t fit the mold.

Now we have the “Woke” climate where diversity is bad, discrimination good! Where slaves sat around the fire singing. It is something right out of the novel “1984” Doublespeak. Sitting around the campfire singing Kumbaya, how did it go out of favor?

Regarding the rancor among the remaining Republican presidential hopefuls as they migrate from New Hampshire to South Carolina, Mike Huckabee, former Arkansas governor and erstwhile candidate himself, told ABC News this week that "There's not going to be some magic moment at which three or four of these people sit around a campfire toasting marshmallows, singing 'Kumbaya' and giving the nod to one of their competitors."

[…]

Like many political phrases these days, says Richard E. Vatz, a professor of political rhetoric at Towson State University, "Kumbaya" is used "irrespective of its derivation."

In current political parlance, Vatz says, a reference to the song is used to sarcastically disparage consensus "that allegedly does not examine the issues or is revelatory of cockeyed optimism."
When did having respect for others become a bad thing?

Insight Global puts it this way,
Attracting top talent can be a challenge when it comes to building a successful organization — and then you have to retain it.

Part of holding onto your staff is ensuring your employees feel valued, welcome, and respected, and one way to do this is through a strong commitment to diversity, equity, and inclusion — also known as DE&I.

In fact, a company’s commitment to DE&I can result in even more benefits than sourcing talent and building effective teams. Utilizing a diversity, equity, and inclusion strategy can give your organization an edge over competitors and strengthen your bottom line. Let’s dig into how, and discuss nine key benefits to DE&I in the workplace.

[...]

Diversity, equity, and inclusion are important to company culture because they foster creativity, fresh perspectives, and understanding. By implementing DE&I, people of different races, abilities, ages, genders, religion, sexual orientation, and other diverse backgrounds can be made more comfortable in the workplace.

The Deseret News had an article about DEI,
These stories point to a conundrum for those committed to expanding opportunity for all Americans: How do we support the values of diversity and inclusion without eroding other important values? American public opinion about racial and ethnic diversity complicates this further.

The majority of Americans of all races recognize the value of diversity in American life. A plurality of Americans of all races believe it is important for businesses to promote racial and ethnic diversity in the workplace. But a majority of Americans of all races also believe hiring and promotion at work should be based only on qualifications, even if this produces less diversity, and they do not believe race and ethnicity should be a factor in such workplace decisions.

[…]

Negative experiences and associations with DEI initiatives would be enough of a challenge on their own. But in our time, a political cancer on America’s race and gender issues has metastasized, transforming negative experiences and associations with DEI into perceptions of threat.
You read comments on these articles and what you see over and over is the right-wing lie about promoting “quotas,” I have been in the business world for over fifty years and not one program mentioned quotas. What they did say was that we will hire and promote the best employees for the job and we will not discriminate based on protected classes.

But the Republicans and right-wingers want to create fear in their white supremacist, white nationalist voters. Create fear that they will become the minorities in the future. That is the real motive behind all this anti-DEI and this “Woke” movement to get their base energized to vote. I didn’t the job because a black man took it! I didn’t get the promotion because they gave it to a woman! All these forgivers are taking my job! That is the fear that the Republicans are creating.

I taught diversity training for about 20 years and never, not once was there any discussion about quotas, not once was there any talk about hiring one group over another. It was always about understanding cultures of other people. But just that pissed off a lot of people. Once when we were doing training at a homeless shelter that they cannot deny shelter to us in our true gender. A guy stood up and said this is “Bull Sh*t” and walked out.

Yes, the Republicans have “weaponized” non-discrimination laws falsely claiming that the laws create quotas, that the laws promote hiring minorities, and that diversity is bad for business.

The latest bubble isn’t overinflated stocks being propped up by Wall Street but instead an overinflated diversity, equity and inclusion industry whose importance was pumped up by a corporate America reacting to the death of George Floyd.

Between 2019 and 2022, DEI positions skyrocketed 170%, according to LinkedIn, with much of that acceleration happening in the wake of nationwide protests and riots in 2020.

“There was an urgency and a national narrative driving that demand,” notes Jason Hanold, CEO of Hanold Associates, an executive search advisory firm.

But that demand quickly leveled, leading to a third of “diversity professionals” out of a job in 2022.

[…]

The rush to build a new diversity infrastructure within corporate America, often operating completely separate from human-resources departments, had companies nationwide failing to ask two essential questions before investing millions: How exactly do we measure the diversity department’s success? And what are these newly heralded diversity officers’ responsibilities?
I know a number of people who teach diversity and they are busier than ever.
In the corporate world, the departments that generate money tend to get larger budgets, but DEI departments across America sliced into the budget pie and continually ate away at it with their pursuit of satisfying their social-justice financial gluttony — and they found many willing to pay.
The author would like you to believe it but there is also something called “Title VII of the Civil Rights Act of 1964”. According to the Federal Trade Administration….
The laws enforced by EEOC makes it unlawful for Federal agencies to discriminate against employees and job applicants on the bases of race, color, religion, sex, national origin, disability, or age. A person who files a complaint or participates in an investigation of an EEO complaint, or who opposes an employment practice made illegal under any of the laws that EEOC enforces is protected from retaliation.

Title VII of the Civil Rights Act of 1964. Title VII of the Civil Rights Act, as amended, protects employees and job applicants from employment discrimination based on race, color, religion, sex and national origin. Title VII protection covers the full spectrum of employment decisions, including recruitment, selections, terminations, and other decisions concerning terms and conditions of employment. See EEOC guidance on race/color, religion, sex, sexual harassment, pregnancy, and national origin discrimination.

Equal Pay Act of 1963. The Equal Pay Act of 1963 protects men and women from sex-based wage discrimination in the payment of wages or benefits, who perform substantially equal work in the same establishment. See EEOC guidance on equal pay and compensation discrimination.

Age Discrimination in Employment Act of 1967. The Age Discrimination in Employment Act (ADEA), as amended, protects persons 40 years of age or older from age-based employment discrimination. The Older Workers Benefit Protection Act amends several sections of the ADEA and establishes conditions for a waiver of ADEA protections. See EEOC guidance on age discrimination.

Rehabilitation Act of 1973. Sections 501 and 505 of the Rehabilitation Act, as amended, protects employees and job applicants from employment discrimination based on disability. This law covers qualified employees and job applicants with disabilities. It also requires Federal agencies to make reasonable accommodation of any known disabilities unless such accommodation would cause an undue hardship. See EEOC guidance on disability discrimination.

The Civil Rights Act of 1991. The Civil Rights Act of 1991 amends several sections of Title VII to strengthen and improve Federal civil rights laws and provide for the recovery of compensatory damages in Federal sector cases of intentional employment discrimination.

Additional information about unlawful discriminatory and retaliatory practices and the remedies is available to Federal employees and applicants who believe they have been subjected to such practices.
The federal laws have teeth! Also employees can suit for big bucks.

Companies also know that diversity is good for the bottom, they know that hiring the best employee and promoting them is good for business.

Once a week, Erin Rothrock holds a syringe filled with exogenous testosterone and injects himself in the thigh.

For Rothrock, a transgender man, it is an essential regimen, one he has followed since he began his transition in 2017. Rothrock has previously received prescriptions for hormones from a registered nurse, while other transgender people have gotten theirs from nurse practitioners. A newly passed law, though, requires patients to see medical doctors for such prescriptions.

That change prompted Rothrock to find a new practitioner, resulting in a delay in getting his testosterone dosage.

Through a combination of new laws and revised rules from state medical boards, transgender residents face an array of new requirements and potential hurdles for continuing the gender-affirming care that some have been receiving for years or decades.

“So, I'm not sure exactly how that's going to affect me at this point yet, but it's definitely very concerning,” said Rothrock, 39. “One of my red lines is if I cannot get continuous medical care in the state of Florida, that me and my family will have to leave the state of Florida.”

Once he and his wife, Jennifer, moved to a Boise suburb last year, Tim Kohl could finally express himself.

Kohl did what the couple never dared at their previous house outside Los Angeles — the newly-retired Los Angeles police officer flew a U.S. flag and a Thin Blue Line banner representing law enforcement outside his house.

“We were scared to put it up,” Jennifer Kohl acknowledged. But the Kohls knew they had moved to the right place when neighbors complimented him on the display.

Leah Dean is on the opposite end of the political spectrum, but she knows how the Kohls feel. In Texas, Dean had been scared to fly an abortion rights banner outside her house. Around the time the Kohls were house-hunting in Idaho, she and her partner found a place in Denver, where their LGBTQ+ pride flag flies above the banner in front of their house that proclaims “Abortion access is a community responsibility.”

“One thing we have really found is a place to feel comfortable being ourselves,” Dean said.

We ranked the 50 states by their hiring rates and were swiftly struck by a trend so clear that — if it holds up — should be front-page news: Republican-leaning states are hiring faster than blue states.

Of the 17 fastest-hiring states, according to the Bureau of Labor Statistics, 14 voted for Trump in 2020. The top two Biden-voting states, Georgia and Nevada, are probably best classified as purple (Biden-blue Delaware is the other). The 10 slowest-hiring states all went for Biden.
Whoa! Why are businesses hiring more in Red states, is it because of politics?
But when we delved deeper, confusion seized our synapses. First, we found this isn’t just a matter of pandemic policies or a Trump-era triumph. This set of states has been hiring faster for the entire decade for which we have data.

More perplexingly, we found that faster hiring hasn’t translated to faster job growth. When we ran the payroll numbers, the typical red state wasn’t adding jobs any faster than the typical blue one.
But job hiring hasn’t resulted in growing economy… hun? Where are the new employees going then?

Experts say the increase in hirings is a result of,
“It’s churn,” he said. Those red states weren’t creating jobs faster. They were just hiring more often because folks were bouncing around more. Red states don’t have more layoffs or job openings than blue ones, they just have more quits and hires.

As Bunker points out, quits and hires track each other closely. They both reflect how fast businesses churn through workers. When you combine quits and layoffs, then chart them against hires, you can’t tell the two lines apart.
So that means there are more disgruntled workers not more jobs.

According to Google’s Bard: “Are businesses finding it hard to get new recruits to move to red states?”
Yes, businesses are finding it hard to get new recruits to move to red states. A survey by the Society for Human Resource Management found that 44% of employers in red states said they had difficulty filling jobs in 2021, compared to 38% of employers in blue states.

There are a few reasons for this. First, many young people and college graduates are more likely to live in blue states, which tend to be more urban and have a more liberal social and political climate. Second, red states often have lower wages and fewer job opportunities than blue states. Third, some people may be reluctant to move to a red state because of its political climate.

As a result of these factors, businesses in red states are having to offer more competitive salaries and benefits in order to attract and retain employees. They are also having to be more creative in their recruiting efforts, such as using social media and networking events to reach potential candidates.

Here are some of the challenges that businesses face in recruiting talent to red states:
  • Political climate: Some people may be reluctant to move to a red state because of its political climate. This is especially true for people who are liberal or progressive.
  • Lack of job opportunities: Red states often have fewer job opportunities than blue states. This is especially true for high-paying jobs in the tech, finance, and healthcare sectors.
  • Lower wages: Red states typically have lower wages than blue states. This can make it difficult for businesses to attract and retain talent, especially in competitive industries.
  • Cost of living: The cost of living in red states is often lower than in blue states. However, this can be offset by the lower wages that are typically offered in red states.
Despite these challenges, there are some businesses that are successfully recruiting talent to red states. These businesses are typically offering competitive salaries and benefits, and they are making an effort to create a welcoming and inclusive workplace. They are also working to connect with potential candidates through social media and networking events.
Again I asked Google’s Bard: “Are medical colleges finding it hard to get new recruits to move to red states?”
Yes, medical colleges are finding it hard to get new recruits to move to red states. A study by the Association of American Medical Colleges found that 40% of medical students said they would be less likely to practice in a red state after graduation.

There are a few reasons for this. First, many medical students are drawn to blue states, which tend to have more urban areas, better public schools, and more cultural amenities. Second, red states often have lower wages and fewer job opportunities for physicians. Third, some medical students may be reluctant to move to a red state because of its political climate.

As a result of these factors, medical colleges in red states are having to offer more competitive salaries and benefits in order to attract and retain students. They are also having to be more creative in their recruiting efforts, such as using social media and networking events to reach potential candidates.

Here are some of the challenges that medical colleges face in recruiting students to red states:
  • Political climate: Some medical students may be reluctant to move to a red state because of its political climate. This is especially true for students who are liberal or progressive.
  • Lack of job opportunities: Red states often have fewer job opportunities for physicians than blue states. This is especially true for specialty physicians, such as surgeons and oncologists.
  • Lower wages: Red states typically have lower wages than blue states. This can make it difficult for medical colleges to attract and retain students, especially those who have incurred significant debt to pay for medical school.
  • Cost of living: The cost of living in red states can be lower than in blue states. However, this can be offset by the lower wages that are typically offered in red states.
Despite these challenges, there are some medical colleges that are successfully recruiting students to red states. These colleges are typically offering competitive salaries and benefits, and they are making an effort to create a welcoming and inclusive environment for students. They are also working to connect with potential candidates through social media and networking events.
What will the long term results of this will be is the $64,000 question.

Glazing into my crystal ball I predict:
  • Medical college will find it hard to fill all their seats in the classroom a) because they will not be teaching what to do during a medically necessary abortions and b) because they will not be teaching about treating patients who are LGBTQ+.
  • Businesses will have a hard time in recruiting a diverse workforce. I predict that businesses in red states will get whiter and more Christian.
In November of 2016 I wrote about diversity…
But here in the U.S. we are a nation of immigrants the person you married might be from an entire different country than where you were born. This has a major effect on the gene pool, we are no longer inbreeding, and we no longer had one culture but were multicultural. We have a variety of ideas; we didn’t do things the way they have been always done. We are healthier, smarter and willing to try new things

[…]

When you have diversity workforce you have diversity in the ideas. Different cultures, race, religions, sex, sexual orientation, and gender identity sitting at the table you have diversity of ideas. We all look at problems differently because of our backgrounds.

When you have no diversity you have group thought. When you have angry WASP as your voter based you are going to have group think… throw out the immigrants… ban the gays… hate for POC…

Yea Connecticut!

Oh what a difference between Red and Blue! One “Woke” open to all, and one exclusionary.
States that are open to all versus states that are based in white supremacy.

Yale University will expand its LGBTQ+ mental health team this fall, in response to student needs.

Wait times for therapy at Yale decreased this year “due to an aggressive recruitment campaign,” said Peter Steere, chief operating officer at Yale Health. The average wait time for an initial appointment with a mental health provider is now four days. Students told Connecticut Public Radio that they’ve had to wait for months previously.

Still, activists say transgender students are falling through the gaps across Connecticut not because of a lack of resources, but because university staff often fail to connect students with resources outside their system.

On a page in a coloring book, a yellow moon hangs low over a leafy green stalk, sheltering cozily napping cats. Anyuye Ai, a 21-year-old student at Yale University, filled in the colors.
While down in Florida… New College of Florida is stripping diversity classes and Black Studies. Healthcare is being band for trans people. Schools are being band from saying anything “Gay.”
 drag queens are band from public places.
She could have got on Yale’s specialty insurance; her parents were able to afford it, she said, but they chose not to, knowing that she would then gain access to gender-affirming care.

The tragedy is that Ai’s solution was located just 17 minutes away in Hamden at Anchor Health, the state’s leading health care center for queer people by queer people, where she finally ended up in January this year.

[…]

In Hartford, Kamora Herrington is a cultural humility educator, and part of her work is to get trans students the resources they need in the community.

“Day one,” Herrington lamented. “[If] someone had just said Anchor, she could have gotten right over. And this is where everyone from soup to nuts needs to know everything. And the gatekeepers need to pull all of their gatekeeping off. Because that's the only way it works.”

Connecticut has some of the strongest laws in the country protecting trans rights. And the Connecticut Department of Social Services was one of the first Medicaid programs nationally to add a wide set of treatment and services for gender transition.

“We have wonderful rights, we've got wonderful protections, we've got wonderful things covered,” Herrington said.
CNN writes,

This year has been record shattering for anti-LGBTQ legislation, with particular scrutiny on gender-affirming health care access for transgender children and teenagers. Nineteen states have passed laws restricting it — but not all bans are the same.

Why Diversity Is Important

When I was in grad school we were asked a question: “Why is diversity important?”

I chose to be one of those in class that explained why diversity is important and my answer was…

My parents are an example of diversity, my father’s father was from a small town in Italy and my mother’s family was from Austria and England. For millenniums people married a spouse from probably less than 20 miles away, the gene pool was very small. But now here in America we can trace our roots to all over the world and that improved the gene pool here.

Cultures. What a blend of cultures we have. Where my grand parents grew up in Italy everyone was Catholic, for holidays everyone had the same holidays, the same parades. But here, in Hartford there is a Greek Festival, a Puerto Rican parade, a Columbus Day parade, a St. Patrick's Day parade, and on and on. How great is that! Being exposed to so many cultures all in one place!

Cultures spill over in to ways of thinking and it can lead to new discoveries, did you know that Steve Jobs and Steve Wozniak tried to sell their new idea of a personal computer to IBM but IBM didn’t want anything from these two hippies.

Did you know that the smartphone, laptop, and computers all use an idea that a trans woman and another person thought of? It revolutionized computers! Lynn Conway,
“For contributions to superscalar architecture, including multiple-issue dynamic instruction scheduling, and for the innovation and widespread teaching of simplified VLSI design methods.”
From the Institute of Electrical and Electronic Engineers (IEEE).
Along with LGBTQ+ computer pioneers like Alan Turing, and Mary Ann Horton who lead the way for many inventions.

When you get a diverse group of people because of their cultures and backgrounds they approach problems from different directions that creates a synergy that comes up with new ideas. Diversity creates thinking outside of the box.

When you stamp out diversity, you create a homogeneous culture that stays in the box.

They Call Us Snowflakes

But who are really the snowflakes?

Snowflake noun
3 informal + usually disparaging
b: someone who is overly sensitive
One side derides the youth driving the movement as snowflakes and social justice warriors, too sensitive and too politically correct.
— Vanessa McCray
Merriam-Webster Dictionary

A teacher here in Southington handed out copies of definitions of words from a dictionary, now these words were not obscene, they just were on diversity. Such as: Indigenous/American Indian, Marginalization, Social justice, transgender, and White privilege and those words got the conservatives hopping mad!

Southington High Diversity Lesson Infuriates Many At BOE Meeting
An English teacher's worksheet addressing various racial and gender issues caused controversy at Thursday's school board meeting.

One high school English teacher's attempt to educate students regarding divisive racial and gender issues has enraged some school officials and community members.

That was clear at Thursday's Southington Board of Education meeting, where Republicans hold a 6-3 edge over Democrats, as the board was forced to deal with the type of controversy seen nationally along political lines.

The issue stems from a Southington High School teacher's worksheet distributed to students on the first day of school, Sept 1.

It reportedly addressed several issues that have divided the nation along political, gender and racial lines.

Items raised included "white privilege," "indigenous peoples," "transgender" people, "institutional racism," gender pronouns, the "Latinx" term and other hot-button political issues dividing liberals and conservatives.

A heated debate over these words?

OMG how horrible! To expose children to these words in high school what is this country coming to?

But this reportedly made some students uneasy, and one took the worksheet to a counselor to raise concerns.

And they call liberal snowflakes, who are the real snowflakes?

But he also voiced frustration about how it mushroomed online and outside the realm of the school board.

Oh yeah, the right-wingers are running with this as examples of liberal indoctrination…

Resident Michael Kryzanski said the three-page worksheet has nothing to do with what should be taught in that particular class.

"I'm paying taxes so my kids can learn how to read, write and communicate properly. I'm not paying taxes for them to learn stuff in this document," he said.

It… it… it might teach children to think on their own we can’t let that happen!

"Pretty much every term I'm reading in this document disgusts me," Kryzanski said. "This is critical race theory, which is not supposed to be taught in Southington Public Schools."

WFSB had this to say about the hubbub,

“It’s troubling to me. I read the worksheet. Do I agree with it? Absolutely not,” said Joseph Baczewski, Board Vice Chairperson.

“We shouldn’t have to talk or treat black people, or people of color, as the packet says, differently because of their skin color. If my friend is a person of color, I will treat them the exact same way everyone else gets treated and I expect the same in return,” said Ella Perillo, 10th grade Southington High School student.

Well unfortunately this happens every day in real life… Black people get arrested for watering their neighbor lawns while they are on vacation, a group of Blacks were walking on his property when he was confronted by a neighbor in Rosewood Florida, hate crimes are skyrocketing across the country, or when a bank refused to cash her  check, maybe  we we should teach diversity and understanding of other instead of lambasting a teacher.

This goes way beyond “snowflakes” this goes to the stirring up of animosity against those who are different by the Republicans, this goes to the worship of a former president who praises white supremacist, this is about a party that wants to divide our country, this is about a party that supports Fascism.

When Diversity Became A Four Letter Word.

In this topsy-turvy world of the new conservative movement where ignorance is bliss and where discrimination is seen as a legal right. The right-wing conservatives are going after schools that believe in diversity.

Top med school putting wokeism ahead of giving America good doctors
New York Post
By Dr. Stanley Goldfarb and Laura L. Morgan
September 2, 2022

Elite medical schools are deliberately recruiting woke activists, jeopardizing their mission of training physicians.

That’s what our organization found in a review of the application process for America’s top 50 medical schools. Nearly three-quarters of these institutions — and 80% of the top 10 — ask applicants about their views on diversity, equity, inclusion, anti-racism and other politicized concepts. The clear goal is to find the students who will best advance divisive ideology, not provide the best care to patients.

Whoa! All of a sudden diversity, equity, inclusion, anti-racism is now seen as a liability? You mean you think it is okay that doctors discriminate?

Many schools explicitly ask applicants if they agree with statements about racial politics. Others gauge applicants’ views on or experience with woke concepts.

So these two people think compassion and empathy in doctors and nurses is a bad thing to ask incoming students? That it is okay for a doctor to be racist?

That it is okay for a doctor to refuse to treat a patient because of the patient’s religion?

That it is okay for a doctor to refuse a patient because they are LGBTQ+?

Other medical schools are more direct. Duke University School of Medicine, tied for sixth place, asks applicants to describe their “understanding of race and its relationship to inequities in health and health care.” Before doing so, they’re told about “Duke’s collective stand against systemic racism and injustice.”

[…]

Across these medical schools, there is now a default assumption that applicants understand and accept the tenets of woke ideology. That’s why the David Geffen School of Medicine at UCLA (ranked 19th) can ask applicants to describe how “inequity has impacted you or your community and how educational disparity, health disparity and/or marginalization has impacted you and your community.”

I think that those are good questions to ask prospective students who are going to healers? When you have way more student applications that there are spots available for them in the medical schools.

I don’t know about you but I don’t want doctors who are bigots!

Can you imagine being wheeled into an emergency room after a car accident and the doctor refuses to treat you because you are a Black gay Muslim, the doctor says “I only treat white straight Christians!”

I don’t want a doctor who is “Me, me, me.” I want a caring compassionate who cares about all of God’s creatures not just those who look and think like the doctor. I don't want a doctor who ignores their oath.

The oath that doctor's take...

Physician’s Oath

AT THE time of being admitted as a Member of the Medical Profession

I SOLEMNLY pledge myself to consecrate my life to the service of humanity.

I WILL give to my teachers the respect and gratitude that is their due;

I WILL practice my profession with conscience and dignity;

THE HEALTH of my patient will be my first consideration;

I WILL respect the secrets that are confided in me;

I WILL maintain by all the means in my power, the honor and noble traditions of the medical profession;

MY COLLEAGUES will be my sisters and brothers;

I WILL not permit consideration of religion, nationality, race, age, gender, sexual orientation, disabilities, party politics or social standing to intervene between my duty and my patient;

I WILL maintain the utmost respect for human life; even under threat, I will not use my medical knowledge contrary to the laws of humanity.

I MAKE these promises solemnly, freely and upon my honor.

LGB… t

Many time we get thrown under the bus by some of our gay brothers and lesbians sisters. We seen this when marriage equality was past… “WE WON!” and walked away to the marriage chapel. Well we seen what happen to the right for a person to chose if they want to terminate their pregnancy after 50 years.

It is the domino theory all over again but instead of countries falling one by one our hard fought legal victories are falling here and around the world.

Poland's Trans Citizens Fear They'll Become Target of the Right
Acceptance of gay, lesbian, and bisexual people is actually rising in the conservative nation, with trans Poles remaining vulnerable.
The Advocate
By Ryan Adamczeski
August 25 2022

With support for gays and lesbians on the rise in Poland, the country’s transgender citizens fear they'll be a major target of the right wing ahead of next year’s parliamentary election.

The same day in June that Warsaw held its Pride celebration, the chair of the conservative Law and Justice party, Jarosław Kaczyński, met with voters in the nearby town of Włocławek to voice his disdain for trans people, The Guardian reports.

“We have elementary knowledge in biology, we know that gender is determined at the level of chromosomes. … In extreme cases, an operation must be performed, but this does not mean that after this operation a man will be a woman and a woman will be a man,” he said.

He taunted the crowd, making a point to look at his watch, saying, “It’s now half past 5; before I was a man but now I’m a woman.”

We have become the low hanging fruit for all the frustrations of the far right-wing conservatives, they hadn’t any luck in making the lesbians and gays whipping boys so now they are focusing their anger and hate at us.

The Polish government has attacked the LGBTQ+ community on several past occasions, with the country’s president, Andrzej Duda, running a successful reelection campaign two years ago based on anti-queer rhetoric. He is a member of Law and Justice.

Recently, polls have shown growing acceptance for gay people in Polish society, which trans activists believe will make them the next target for the party. Trans author Maja Heban told The Guardian that Kaczyński’s June remarks amount to “workshopping” material for upcoming campaigns.

Polish politician Krzysztof Śmiszek added that “homophobia doesn’t resonate the way it used to” with Polish society. Śmiszek is head of the parliamentary group on LGBT+ equality and member of Parliament from the New Left party,

“Poland in 2022 is not so easy to be manipulated with homophobia … Kaczyński consciously did not choose the entire LGBT group, but only transgender people,” he said.

Where are our gay brothers and lesbian sisters do they have our back in Poland or are they ducking for cover and glad that it is not them? I sometimes feel that it is more like LGBtq

In politics here in the US a Republican doesn't like diversity... he wants everything "Lilly White."
Masters, of Arizona, defended the remarks in a video and lashed out at what he called President Joe Biden's "affirmative action regime."
NBC News

Blake Masters, the GOP nominee for a Senate seat in Arizona, suggested in a sarcastic tweet this week that the sluggish economy and the high rate of inflation were tied to diversity in the high ranks of the Federal Reserve.

"Finally a compelling explanation for why our economy is doing so well," Master, who has been endorsed by for President Donald Trump, wrote Sunday in retweeting an Associated Press article with the headline: "Fed tackles inflation with its most diverse leadership ever."

The article noted that more female, Black and gay officials are now weighing in on interest-rate decision-making than ever before in the central bank's more-than-100-year history.
All this diversity makes my head spin!

I want only people who look and think like me, none of these blacks and immigrants, none of these fruit cakes and… and… and none of these WOMAN! And god forbid women in pants!

In May, he was among a group of conservative candidates who invoked versions of the “great replacement theory” — a conspiracy theory that claims there is a plot to weaken the influence of white Americans — by saying Democrats want to give amnesty to thousands of immigrants to claim them as voters.

Masters has also disparaged Black women, having previously argued that Supreme Court Justice Ketanji Brown Jackson, the first Black woman confirmed to the high court, was “a horrible pick” and an “affirmative action candidate.”

In Monday's video, Masters also attacked Vice President Kamala Harris, who he said was “so incompetent she can’t even get a sentence out.”
Take me back to the land of “Mayberry,” “Ozzy and Harriet,” and “Father Know Best”!

Bloomberg reported that there is actually a lack of diversity in the Fed...
There are currently five female Federal Reserve bank presidents, including Lorie Logan, who leads the Dallas branch. Lisa Cook is the Federal Reserve’s first Black female governor. Federal Reserve data released in May, however, show that the overwhelming majority of employees are male and White.

Further, four of the 12 Federal Reserve banks don’t employ a single Black economist, and there has never been a Latino leader at the organization. Women comprise fewer than a third of the economists at the central board as well as 11 of the 12 branches. The board counts one Black man among its 400 economists. There are currently no Black female economists at the board. The bank employs no Native American or Native Hawaiian and other Pacific Islander economists.
Back in grad school I was asked why diversity is important. It was a very easy question to answer, when you have a homogeneous company everyone thinks the same way, in a diverse business different cultures, religions, race, genders, and sexual orientation all shape they way people think bring many new ideas and ways of thinking to a company.

I like to use IBM as an example. Back in the late sixties and the seventies you could spot an IBM rep a mile away… they all had a “flat top” haircut, a blue suits, a thin blue tie, and a pocket protector.
Then this rising star came along who invented a way to speed up computers that is still used today, "dynamic instruction scheduling” (As eyes glaze over) it was an earth shattering invention that was latter said to be one of the major discoveries in computer science. But IBM fired their rising star, why?

Because she came out trans in the land of the flat top haircuts, a blue suits, a thin blue tie, and a pocket protector, Lynn Conway went on to be one of the must influential computer scientists of this generation.

Then we had two hippies who walked into IBM with their idea but were entirely dismissed of their garage workshop invention… the personal computer. IBM was mainframes not these little toys. IBM brought men to the moon! Those two hippies went on to found Apple!

When you have a diverse workforce you get new ideas, not old ideas rehashed.

~~~
Note: I am not painting the whole LGB community, it is just small group of individuals who are ant-trans. The vast majority of LGB support us. But like most groups they are only interested in their own community.
It Is Our Right To Discriminate!
That is what the Republican Attorney Generals what to do, discriminate against us in the school meal programs. They want to deny us breakfasts and lunches at school!
Republican AGs sue US agency over LGBTQ school guidance
July 26, 2022
More than 20 Republican attorneys general filed a lawsuit Tuesday against President Joe Biden’s administration over a Department of Agriculture school meal program that prohibits discrimination based on sexual orientation and gender identity.
The challenge, led by Tennessee Attorney General Herbert Slatery, claims that the federal government is attempting to force states and schools to follow antidiscrimination requirements that “misconstrue the law.”
The coalition of attorneys general are hoping for a similar result to a separate challenge from earlier this month when a Tennessee judge temporarily barred two federal agencies from enforcing directives issued by Biden’s administration that extended protections for LGBTQ people in schools and workplaces.
The judge sided with the attorneys general, ruling that the directives infringed on states’ right to enact laws, such as banning students from participating in sports based on their gender identity or requiring schools and businesses to provide bathrooms and showers to accommodate transgender people.
“This case is, yet again, about a federal agency trying to change law, which is Congress’ exclusive prerogative,” Slatery said in a statement. “The USDA simply does not have that authority. We have successfully challenged the Biden Administration’s other attempts to rewrite law and we will challenge this as well.”
Isn’t funny that they have no problem with passing federal laws banning abortion but when it comes to LGBTQ laws and executive orders their cry is “states rights!”
According to the lawsuit, the attorneys general allege that the USDA’s new directive is based on a “misreading” of the Supreme Court’s ruling and did not provide states and other groups the opportunity to provide public comment.
I thought it was pretty clear, that “sex” also includes gender, not only in the last ruling in the case of R.G. & G.R. Harris Funeral Homes Inc. v. Equal Employment Opportunity Commission where the judges said in part,
“Discrimination on the basis of homosexuality or transgender status requires an employer to intentionally treat employees differently because of their sex—the very practice Title VII prohibits in all manifestations.”
The states that involved in the lawsuit against the USA are,
The attorneys general involved in the lawsuit filed Tuesday are from Alabama, Alaska, Arizona, Arkansas, Georgia, Indiana, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia and West Virginia.
Gee did you happen to notice that they are all Republican controlled?
Meanwhile, college students also want the right to discriminate, they don’t want no education in diversity or inclusion! We don't need no thought control!*
Fox News via Yahoo News
By Elizabeth Economou and Nicole Pelletiere
July 27, 2022
Some universities across America are requiring compliance from faculty in the form of signed diversity, equity and inclusion (DEI) statements, as conditions for tenure or promotion — arguing that DEI across college campuses is a top priority.
However, there may be growing pushback in some areas from faculty as well as from parents — who claim that the DEI agenda actually challenges the diversity of viewpoints and opinions of students within the college environment.
Some say it also promotes a culture of fear and intimidation.
In the city of Seattle, for example, roughly 40 percent of the University of Washington's faculty recently rejected — or abstained from voting on — a measure that would have required faculty members seeking advancement to provide a statement demonstrating their support of DEI.
The Fox article goes on to compare diversity training to the Communist,
"One political viewpoint is being pushed very hard by the administration and by a number of others," said Mass, who is also a meteorologist.
To him, he added, "diversity statements" appear very much like "the anti-communist loyalty oaths of the late 1940s and early 1050s."
Students who hold even moderate viewpoints are often afraid to express themselves, he said.
"Requiring all faculty members to support a social/political agenda favored by one segment of society not only politicizes the university, but represents ‘compelled speech,’" he noted recently in a blog post.
It's "a violation of the First Amendment of the U.S. Constitution at a public university," he added.
Hold it right there!
First, diversity training does not tell you how to think! You can think anything you want, you can say anything you want what diversity training does is it teaches that it illegal to discriminate!
It makes you aware that giving a lower grade to a Black student and higher grade to a White student for the same work is illegal. It makes you aware that never calling on a trans student in class is illegal. And it does not violate the First Amendment.
It doesn’t make being an a**hole illegal but it do make picking on students because they are trans or  Latinx illegal.
She said that "DEI proponents (and their allies) use linguistic gymnastics to change the very meaning of words, in order to manipulate the masses into believing propaganda."
"We collectively understand the word 'diversity' to include respectful debate of diverse opinions, open and honest discussion, respect for others, even when we disagree."
[…]
"Their definition of ‘diversity' is twisted and is the exact opposite of our understanding," she said. "Their ‘diversity’ accepts only their group-think opinions, their stifling of true debate, their silencing of diverse ideas and their tyrannical control of all content."
It is they who are twisting words, it doesn’t stifle debate but rather it curbs behavior. You can think all the vile thoughts you want but when you act upon those thoughts you have crossed the line.
We can disagree and still love each other, unless your disagreement is rooted in my oppression and denial of my humanity and right to exist
