Another Lawsuit That Affects Our Lives!

Another lawsuit filed against Trump's hatchet job.

Doctors from Harvard Medical School have filed a lawsuit challenging the Trump administration's removal of articles about their research from a government-run website focused on patient safety because they referenced people in the LGBTQ communities.

Represented by lawyers at the American Civil Liberties Union, Drs. Celeste Royce and Gordon Schiff filed a lawsuit on Tuesday in Boston federal court alleging their articles were removed as a result of an executive order President Donald Trump signed requiring agencies to remove statements promoting "gender ideology."
 
Their articles were published on the Patient Safety Network, a website that features news and resources on patient safety. It is run by the Agency for Healthcare Research and Quality, which is part of the U.S. Department of Health and Human Services.

The doctors' lawsuit argues that the Trump administration violated the U.S. Constitution's First Amendment by imposing a viewpoint-based restriction on the doctors' participation in a government-provided forum open to private speakers.
I'm not a lawyer but the lawsuit does sound interesting using the First Amendment!
The lawsuit also argues the administration violated the Administrative Procedure Act by removing articles without a reasoned basis.

 "Censoring information about transgender people or anyone a politician does not like, who have documented increased risks of negative health outcomes, is antithetical to the very mission of public health," Schiff said in a statement.
Yeah... Trump & Company has to follow the rules!!!! But the question is will he ignore the court order?

One of the articles removed was a commentary about endometriosis diagnosis, which states that “it is important to note that endometriosis can occur in trans and non-genderconforming people and lack of understanding this fact could make diagnosis in these populations even more challenging,” according to the filing. The other article that was removed was about assessing suicide risk in patients, and noted that high-risk groups included “Lesbian, gay, bisexual, transgender, queer/questioning (LGBTQ)” along with other groups.

On Jan. 31, Schiff, one of the plaintiffs and an author of the article related to suicide risk, received an email from Patrick Romano, one of the co-editors in chief of PSNet, stating that the article was “removed from the PSNet website due to a perception that it violates the White House policy on websites ‘that inculcate or promote gender ideology,’” according to the filing. Romano went on to explain it was the result of the executive order related to “gender ideology” and a subsequent memo from the Office of Personnel Management that ordered federal agencies to “Take down all outward facing media (websites, social media accounts, etc.) that inculcate or promote gender ideology.

The plaintiffs are also arguing the move violated the Administrative Procedure Act, which regulates how federal agencies are supposed to proceed when changing or making regulations. They are arguing that the administration’s moves are “arbitrary and capricious,” made with insufficient thought given to the consequences of removing the articles from the database. A similar argument was made just weeks ago, in a lawsuit challenging the National Institutes of Health’s proposed slashing of indirect costs.
Trump, Musk, and et al... do not care if it harms us! They removed research on suicides that could save someone's life!
