The 19th Explains: How bathroom bans on federal property would impact trans Americans
A proposed bill in Congress would ban trans people from bathrooms in museums, national parks and other federal property. How would it be enforced, and what are the consequences?

November 27, 2024Congress has a long list of pressing priorities — including funding the federal government to prevent a shutdown — that it is likely to put off until 2025. One new item packed on that to-do list: legislation introduced by GOP Rep. Nancy Mace to ban transgender women from women’s restrooms, and transgender men from men’s restrooms, on any federal property.
The South Carolina lawmaker proposed this bill after launching a campaign to remove newly-elected Rep. Sarah McBride of Delaware from women’s restrooms on Capitol Hill. After House Speaker Mike Johnson announced a rule that effectively matched her initial proposal, Mace expanded her proposed bill to restrict the ability of all trans Americans to use restrooms, locker rooms or changing rooms on federal property across the country.
How long did it take? Two, three weeks to come after us?
Believe it or not… there is a case before the Supreme Court: United States v. Skrmetti that is about our healthcare. But we need to be aware of how they rule on case, if they stick with the states we are screwed! But if they rule in favor of us we have to see why they voted that way and it could help us with bathroom.
Now when they say “birth gender” how are they going to enforce it? Birth certificates? Driver licenses? Or DNA testing? What about intersex people?
If passed into law, how would such a bill be enforced, and what would be the consequences? And what is the atmosphere like right now for transgender lobbyists and advocates who work on the Hill? The 19th spoke with multiple experts to find out.
Such a far-reaching law would mean widespread discrimination against all transgender people, experts say, although Mace’s rhetoric has singled out trans women. It would have the potential to expose trans and nonbinary people to harassment and discrimination at national parks, courthouses, IRS buildings like taxpayer assistance centers, Social Security Administration offices, and some post offices and Native American lands.
ABC News reported,
When it comes to specific policies, about half of Americans in that poll (including 78 percent of Republicans and 29 percent of Democrats) seemed to agree with Mace on bathroom bans, telling YouGov they think transgender people should use bathrooms that correspond to their assigned sex at birth, while 34 percent thought they should use bathrooms that align with their current gender identity, or either option.
The Republican myopic rush to pass anti-trans laws just don;t think about trans men.
When the news announced Rep. Mace the news media said that the bill was targeted at Rep. McBride but now the truth comes out... it is national wide!
