The provision might lead to a potential ban on the sale of many hemp-derived products that contain intoxicating forms of THC. On November 9, the U.S. Senate approved a continuing resolution that includes a clause preventing the “unregulated sale of intoxicating hemp-based or hemp-derived products, including delta-8 [THC]” in places like gas stations, corner stores, and online.The proposed measure redefines “hemp” in crucial ways. Under the provision, a finished hemp-derived cannabinoid product must contain no more than 0.3% total THC (including delta-9 and similar cannabinoids) and no more than 0.4 milligrams of total THC per container, according to Cannabis Business Times. The language also prohibits use of “synthetic” cannabinoids or those manufactured outside the plant and appears aimed at shutting the door on many of the newer hemp-derived intoxicating products.

If enacted, this bill would impose a federal ban on most hemp products that are currently on the market, even in states like Georgia where intoxicating THC products are legal and regulated. THCA products like THCA flower, while already prohibited in Georgia, would become illegal controlled substances nationwide.Other products like vapes, drinks, edibles, and pre-rolls containing Delta-8-THC, HHC, THCP, and other intoxicating cannabinoids extracted from hemp would lose their classification as legal hemp products and become controlled substances. Distillates and isolates containing these hemp extracts would also be prohibited as consumer products.[...]In short, there are several challenges that the hemp industry can raise if this new bill is passed. However, the federal government will push back hard, and it is important that any effort to strike down this new bill be led by experienced advocates well-versed in legal and scientific issues involving hemp.
Prohibition II?
No one knows, this whole things was passed in secret so we don't even know what the law will cover because it was never debated on the floor of the Senate!
