The Department of Homeland Security's Office of Intelligence and Analysis policy manual has omitted "sexual orientation" and "gender identity" from a rule prohibiting "intelligence activities" targeting someone on the basis of their identity.

Context

A spokesperson for DHS told Snopes that the department will not engage in surveillance based on a person's sexual orientation. The language change in the manual folds discrimination based on sexual orientation into "sex discrimination" at large, per the U.S. code, according to the spokesperson.

In February 2025, as U.S. President Donald Trump called for an end to diversity, equity and inclusion practices in the federal workforce, reports claimed the Department of Homeland Security — led by Secretary Kristi Noem — had removed bans on conducting intelligence activities on people based on their sexual orientation or gender identity.

Such reports shared copies of the original DHS report, which showed a rule that originally prohibited personnel from conducting intelligence activities based only on a person's "race, ethnicity, gender, religion, sexual orientation, gender identity, country of birth, nationality, or disability." The latest such report appeared to have removed the references to sexual orientation and gender identity.

The DHS quietly updated its policy manual earlier this month, removing LGBTQ+ identities from the section prohibiting surveillance based solely on immutable characteristics.

The Department of Homeland Security has eliminated policies preventing the investigation of individuals or groups solely based on their sexual orientation or gender identity.

The DHS Office of Intelligence and Analysis quietly updated its policy manual earlier this month, as first reported by Bloomberg, removing LGBTQ+ identities from the General Requirements section that prohibit surveillance based solely on immutable characteristics.

The manual now states: “OSIC Personnel are prohibited from engaging in intelligence activities based solely on an individual’s or group’s race, ethnicity, sex, religion, country of birth, nationality, or disability. The use of these characteristics is permitted only in combination with other information, and only where (1) intended and reasonably believed to support one or more of I&A’s national or departmental missions and (2) narrowly focused in support of that mission (or those missions).”

So translated from Newspeak it means that they can investigate us just because we are trans!!!!

We are now possible terrorist of the nation just by being trans!

Trump’s appointed pick for Secretary of Homeland Security, Kristi Noem, has a long history of targeting LGBTQ+ rights. The former governor of South Dakota signed executive orders banning gender-affirming care for youth and transgender athletes from participating in sports teams that align with their identity.

The Office of Intelligence and Analysis states on its homepage “I&A’s main focus is to provide the Department with the intelligence and information it needs to keep the Homeland safe, secure, and resilient.”

The Brennan Center for Justice reported the “Department of Homeland Security. DHS’s Office of Intelligence and Analysis (I&A) has for years engaged in abusive domestic intelligence practices targeting Americans’ political views and broadly painting certain groups of Americans as terrorists. Since at least 2016, I&A officers have conducted interviews with people held in jails without sufficient constitutional protections, targeted journalists and activists protesting local monuments under the guise of homeland security, surveilled racial justice demonstrators, and monitored political views shared by millions of Americans — about topics like abortion, government, and elections — that DHS baldly asserts will lead to violence.” 

And it is not just us worrying about where this could lead but also one of the Supreme Court justices, Justice Sotomayor said this...

“The implications of the Government’s position,” Sotomayor stressed, “is that not only noncitizens but also United States citizens could be taken off the streets, forced onto planes, and confined to foreign prisons with no opportunity for redress if judicial review is denied unlawfully before removal. History is no stranger to such lawless regimes, but this Nation’s system of laws is designed to prevent, not enable, their rise.”
