2019 Legislative Session

Current status of the bills that we are following:

HB-5505 AN ACT CONCERNING THE UPDATING OF STATE FORMS AND APPLICATIONS TO INCLUDE A NONBINARY GENDER OPTION. --- Passed out of committee

HB-6219 AN ACT CONCERNING SAFE BATHROOM FACILITIES AT SCHOOLS FOR GENDER NONCONFORMING STUDENTS. --- DOA (JF Deadline passed without a vote). The current law covers this...
"(21) "Gender identity or expression" means a person's gender-related identity, appearance or behavior, whether or not that gender-related identity, appearance or behavior is different from that traditionally associated with the person's physiology or assigned sex at birth, which gender-related identity can be shown by providing evidence including, but not limited to, medical history, care or treatment of the gender-related identity, consistent and uniform assertion of the gender-related identity or any other evidence that the gender-related identity is sincerely held, part of a person's core identity or not being asserted for an improper purpose."
Under the current law it just says their gender identity... it does not say male or female. Therefore someone who is non-binary does not identify with their gender assigned at birth and therefore are covered by the current law. One of the things that we made sure when we were trying to pass the bill is that it covers non-binary, genderfluid, and crossdressers.

HB-7359 AN ACT CONCERNING A LESBIAN, GAY, BISEXUAL, TRANSGENDER AND QUEER HEALTH AND HUMAN SERVICES NETWORK. --- Passed out of committee

SB-58 AN ACT CONCERNING GAY AND TRANSGENDER PANIC DEFENSE. --- Passed out of committee

SB-388 AN ACT CONCERNING INTERSEX PERSONS. --- Passed out of committee, it was substantially modified by the committee. It is now basically a bill to add “intersex” to the non-discrimination statues and add a third option to gender markers on state document.

So what now?

Bills starting with HB move on to the House for a vote on them and bills stating with SB move on to the Senate for a vote (funny how that works).

If the bill passes their respective chamber then it moves on to the other chamber; however, all bill must be passed by June 5th when the current legislature session adjourns at midnight.
