Over the U.S. Department of Education Office of Civil Rights release of the questions and answers of the Dear Colleague letter of 2010 on bullying and the 2011 Dear Colleague letter on sexual harassment, you would that OCR had just ruled that Title IX covered gender identity.
A little bit of history, back in of 2010 the OCR released a letter to all school boards in the U.S. saying the schools must enforce Title IX and that bullying based on sex stereotypes included gender identity. It listed some of the areas that are covered in Title IX, in that list they said that gender identity is covered under Title IX.
Office of Civil Rights and the U.S. Department of Justice has been enforcing Title IX during the Obama administration and in California's Arcadia School District in 2013 the DOJ and the OCR came down hard on them. The agreement showed that the Departments of Justice and Education believes that the Title IX does cover gender identity and expression and that the laws also cover sex-segregated facilities.
